Congrats on your 140 approval, Now to your qns.

1. The approval notice goes to your attorney. You can request a copy from him/her. Generally takes 5-7 days.

2. Looks like your PD is sept 2003 and you are EB3. If you belong to any of the retrogressed countries (india.china,philliphines), your 485 will not be adjudicated till your PD becomes current. Right now, the PD for EB3 retrogressed countries is june 2002. Looking at your id, I am assuming that u are from India.

3. But since you have your 140 approved, once your 485 is pending for > 180 days, you can change jobs (if required using AC21).

4. If you have not yet FP'd, you might get your FP notice.

Some called the emergency number and with a little luck got through to a nice officer.

47% of the 17 Oct/Nov EB3 candidates have been approved by now, one RFE and the rest still no decision. While I was a little worried about the latter, according to immigrationwatch.com
- this pending state is completely normal (unfortunately)
- might last for long times (their statistics point towards 8 more months)

For myself I decided that researching why my case is still pending while 47% are approved is a waste of time, so I am trying to not think about it too much anymore.
Of course, eventually I will make sure that my case has not fallen of some shelf...

Anyway, good luck to you and the rest of us 53%.
 
Considering the current processing time is in Nov 10, 47% is not that bad number. When they approach the end of Nov, I would expect 47%/(40/60) = 70.5% approval. Am I fool? What can I say!?

No fool, good guess. Problem is that the tracker only contains 17 cases, and only 2 of these fall into the time period in question...
 
My colleague is approved on Apr21. Am the only one left out now
from my work.

----Yes, it is safe if you satisfy the requirements of AC21 (140 approved and 485 pending > 180 days). There are some known risks (but can be overcome eventually)...if your employer who sponsored the GC revokes the I-140...you might get a NOID (Notice of Intent to Deny) on your 485...but you can provide AC21 letter and get your approval. This happens only if the employer wants to trouble you and approaches USCIS to revoke the approved I-140. Pls. note that after 180 days of 485 pending, the employer loses control over an approved I-140.

----The retrogression came into effect on Jan 1, 2005..but it affects all those pending EB3s who have a PD after the current EB3 visa date. The only advantage of filing 485 before Jan 2005 was that you could enjoy interim benefits of 485 pending (like EAD and AP) and ofcourse the biggest PLUS being able to use AC21. But you will still be impacted by retrogression....But look at it this way, if you were not able to file 485 at all...then you would have been stuck with that employer till your PD becomes current...but now since you have your 485 filed, you can enjoy AC21 if required.

I did my FP in December itself.

EB3, Sub Labor, Concurrent, RD 10/04/2004. AP, EAD received, FP done.
No LUD no nothing.

Did you guys - fivemiletom, lorestan call up the emergency number and found out why things have not moved in your cases.
Can I ring up the emergency number (949-389-3007) with the justification that on the website the current processing date is Nov10, which is more than 30 days than my RD. The number on the site is all automated and totally useless.

I haven't. My understanding is that one should not call the emergency number
right after the 30 days have elapsed (but first take the steps outlined by USCIS: inquiriy etc).
But I have not heard of any cases were calling it had a negative impact on a case.

got an email from uscis today...the moment i saw the email in my tray icon...i was hoping like mad with fingers crossed that it should none other than an approval notice :)

my gc process started in feb 2002..
140 RD Oct 22 2004 AD April 22 2005

485 LUD jan 22 2005 (i did FP on Jan 18 2005)

got EAD and AP sometime in Jan end 2005.

not sure if i would get 485 as well...

and its EB2, 300+ employees , s/w company in santa barbara.

I don't think calling emergency number will hurt your case in any way. The worst case could happen is that you get someone who is not willing to tell you anything.

I called emergency number when the current processing date was 10/18, which passed my ND of 10/05/2005. I was lucky to get a nice guy and he told me some infomation such as "your security check is cleared" and "your cases should have been assigned to an officer and you will hear back from us in a couple of weeks". I got LUD after I called.

And today I got emails about RFE on my 140 and RFE on spouse's 485.

Give it a shot.

Hi Gran_Confusion,
Yes, I called and left a message today, as if they are going to call me back. I will call them tomorrow to get the status of my case. Another guy with the same RD as me got an RFE today. We'll see how it goes I guess.

I have the same RD as you. So you got an RFE????I wonder what it is about...I am in the same boat...Most probabely, I get a response very soon...

My 140 is cleared. I did not get the email yet. I checked
status with my WAC at 9.30PM Apr 25 and it says case
is approved. Approval letter is mailed on Apr 22.

Thats the end of another waiting stage. And entering
another waiting stage. ( Is life all about waiting?? )

posted everything I could.

I wish and pray to Lord Krishna that all of you who are waiting will soon
get your approvals
