Those who applied in oct/nov 2004

I know it gets very frustrating. It is easy to preach but very tough to take on when it comes on to oneself.
I was also told the same thing. Infact, the officer advised me to get H1 extension and told me that the case might take long time.

This happened on 4/1 and the approval email I got today says 140 was approved on 4/1. It means, when I was talking to the officer, by that time either the case was approved or under final stage of approval. Or may be talking to the officer and his puting priority helped, I am not sure.

To summarize, immediatly after being told that name check was pending etc. I got 140 approval. It happened at a time when I least expected it due to my discussions with the immigration officer.

I would say, do not give much to the name check funda based on experience in my case.

I have tried to argue that I140 should not be stuck while name check is pending but the person seemed to disagree and I did not insist too much. I did not want to upset USCIS altough they are wrong.

I asked my lawyer to call to check on my I140 to see if they can reason with them ...

I am also very confused since I did request an FOIPA request and got a response for a "No Record" for both my wife and I.

From the details of your case I can see that you replied to CSC more than 2 months after the RFE.
How long is the maximum delay to respond RFE?

you are right, we took almost 2 months to respond. Other documents were ready except EDD form DE-6 (Quarterly wage report), which must be sent in sealed envelope as received from EDD. They take a lot of time (took 4-5 weeks for me) in sending this kind of report and in some cases even refuse to provide it.

In my case USCIS had given 84 days to repsond. Had read somewhere that now there is not time limit but I might have just partial info on this.
 
Congratulations GC_GoneCase! I am glad to hear your 140's approval and I am hoping mine is on the way too since my RD and ND is exactly the same as yours... No LUD change for my 140 either so far...

You could be right. However, I think the fact that they were trying to process 140 and 485 concurrent in CA till recently, could also mean waiting to process 140 till time 485 is also ready.

This looks to be changing now as with EB3 retrogressed, 140 is no more dependent on readiness of 485.

I would be extremly happy to have 140 approved as then I can use AC21.

I contacted my lawyer office so they can call the CSC emergency line to make sure that the I140 is not blocked.

Well my lawyer now claims that I140 has a name check on its own as well.

This is the first time I hear about that ...

Anyway I would like to know if anybody has info about that:

Does I-140 requires name check?

I may start another thread on this subject.

Congrats GC_gonecase & bluewater.

I gave the FP for my kid on April 1,2005. On April 5 the LUD has changed but not the message.

Do you know if your I485 passed the dreadfull name check hurdle?
 
Late JIT!

It is almost 3 weeks since the last update for JIT.
I am wondering when USCIS will post an update.

They are supposed to post every 2 weeks no?
 
it was last updated on 14-FEB-2005 with no reason. i don't know whether my I485 has passed name check. could you please let me know how to verify whether it has been passed or not.

I called the emergency number (949-389-3007)

I just called the emergency number, and i'm told that the name/background check has been completed on 11-FEB-2005. I guess LUD (14-FEB-2004) on my 1-485 was due to that reason.

Does the LUD comes with any message change to the 485 case itself (like Name Check cleared)?

Coz, several people here also had LUD on 485 without new message, just want to know if this means these cases also have cleared Name Check?

I too had an LUD on I485 on 3/21/05 but emergency operator told me that the name check was not completed.

Did the emergency person told you more about your application then?

Update doesn't say anything about the name check though. It is the same message since FP results LUD

Operator did say that the name check has been cleared and there is no visa number available yet for my 1-485. My PD is 10-APR-2002
