I applied to I140 alone and it ended up in TSC. now that i wana apply for the i485 and ead and the AP, i know that I should send the papers to NSC. but my question is , where my i485 package will end up? will it go to TSC or there is a chance that it stays in NSC?

I read about the bisepcialisation program but they after 7/24/2006 they r not mentioning that i485 end up in the same center as the one of i140. pls advise.

Texas I140 processing dates changed to Mar 8th last evening.Previous date was Feb 23rd and my I140 RD is Feb27th.I filed only I140,EB2 substitution labor.Can anyone predict abt the approval please?Thanks in advance.
 
I-140 can be filed by attorney or any other representative or company owner himself.
I-485 can be filed by candidate himself or a representative or attorney.

You mentioned that you did not get any email notification for EAD or AP. Did you get any LUD before approval for those two? did you set up your portfolio by the AP or EAD approval date? Looks like you got the fastest approval and I was wondering if you received the Receipt notices to track the LUD and emails for AP and EAd.

For AP & EAD approval i didn't get any email notification.
 
I-140 Processing Times

All any of us can do is guess. Based on the postings on this site (that you can read for yourself), the processing times for I-140's in the Texas SC seems to be anything from 4 weeks to the official USCIS 6 months. The USCIS newsletter for September 2006, refers to a 3 month processing times for I-140's generally. Again, as you can read on this site, the processing times for I-140's seems to be significantly shorter in Texas as opposed to Nebraska.

My lawyer contacted me today to tell me he got a "notice of intent to deny" for my I-140... is that the same as an RFE? If not, what is the likelihood of getting my case approved if we can address their issue with my I-140 (employer's ability to pay)?

PLEASE shed some light here... I'm so upset, frustrated, confused...

I'd really appreciate any input!

I learned today that my I-140 has been approved. This forum has been a great source of info and I hope my details may give you some idea of the latest I-140 processing rates at TSC. Good luck to you all...
 
Congratulations! Wow, it seems that you I-140 was approved really fast, less than a month...I am wondering how's the status of my case :confused:

NOID is considered to be worse than RFE (you can tell even from the term itself). But if you can resolve the issue satisfactorily, you should be Okay.

Ability to pay was my RFE. You can show ability to pay many ways. even it is NOID at least they didnt deny at all. so you still have chance to prove the case. I hopw you company has a good record of financial status for former years and they are willing to show. talk to them. It works.

I thought if you have been employed with the petitioner for a while (I am not sure how long it has to be), that in itself proves the petitioner's ability to pay. Is this not the case any more? (I think that makes sense, but I guess what I think makes sense is irrelavant.) Anyway, I am sorry to hear some people being deniced of their cases. Wish all of you the best!

Ability to pay is not a problem if you get the same salary you show on labor appl. However if you dont get the same amount of wage, they are asking the company ability to pay. It doesnt matter how long you have worked. green card applications are always for future employement. but you have to show the ability to pay from priority date.
I am not a lawyer. These are just what i know and my opinions.
