It seems your case in under pilot project. Yesterday I noticed first LUD in I-131 and today I got an approval mail from USCIS. I hope they approve 140 & 765 soon. Do you know what is the order of approval ??? Find below my case details.

Chekc your signature. How can your 140/485 is 08/27/2005? Today is still 08/17/2005 as far as I know :)

Does the case status on INS website get updated along with application processing. Do they take longer to update the web page?

140 Approved

I got my 140 approved today. Approval notice sent to attorney. It was filed on July 26 2005. This is fast. Weird thing is, I did not get any email from USCIS website. There was a LUD on 08/15/2005.

lc4gc, the receipt said the same thing for me too but it is not taking that much time. good luck to you.

My I-140 has RD:8/1/2005, ND:8/3/2005 (I-797C reciept notice sent out), then I saw LUD 8/18/2005, but no email and nor web on-line status change. Wish I would see snail mail from USCIS next week as you lucky guys .

You will get approval message Monday 8/22/2005. Good luck. But my EAD got approved on Friday, But no LUD on I-140.

Don't believe the website

As I said before, my i40 got approved but on USCIS website, it still says "taking 300-400 days blah..blah..." I already have the approval on hand. So, do not be surprised if you don't get any email notification after approval.

Any way, the case is EB-3.

Hi Ic4gc,

you can notice LUD in Log in page. Regard Receipt Date/Notice Date. I guess it may vary to each cases. For me the receipt date in 7/27, But noticed LUD in 7/29, after I got receipts and login in to USCIS site. I guess they have printed out Receipts on 7/29.

I am EB3, so I can only file 140. but if you fill out the form of 140 as concurrent, it means you file them together.
but I am not sure whether you can send 485 10 days later than 140...I do hear somebody did this...

anyway, the earlier the better...


You can do semi-concurrent filing what this mean is apply 140 first, then using I140 receipt we can file I485. Most of the time you might receive 140 receipts with in 10 days. But you have to attach 140 receipt to your 485 file. Talk to lawer to get more information.

You cannot file I-485 unless the PDs are current. Also, I-140 cannot be approved unless PDs are current, I think. Previously, concurrent filing/semi-concurrent filing was possible even if the PDs were not current. In such cases, I-485 will remain "pending" until the PDs became current. In any case, the premise for I-485 is that I-140 should be approved and a Visa number should be available.

Also, I-765/I-131 cannot be submitted unless I-485 is pending for adjudication

Are you sure that I-140 cannot be approved unless PDs are current? Or did you mean to say that I-485 cannot be approved unless the PDs are current?

I am not sure about pros & cons of semi-concurrent filing. Talk to good lawer on this get more information and procedures to file semi-concurrent.

Where on the web we can find visa numbers available or not? I am EB2, but a Chinese national. PD:08/2002/TX/LC Approved 08/08/2005. Also, long time ago I heard that I can file 140 in U.S. but I am allowed to file 485 in my country either China or the country my citizenship is. Is it right? Do I still wait for visa numbers over in those countries?

Visa numbers are currnet for EB2 cases. Go ahead and file concurrent.(140/485). You can file 485 here.

Skapa's case is EB3 with Priority date of Aug 2002. he/she got 140 approved in 20 days, but he/she could not file I485 until october if visa number is available.

for people of EB3 file concurrent before visa number is not available, their I485 will be pending as a pipeline...

this is what my attorney told me and conclusion after I read several lawyer's websites.

correct me if I am wrong...

Skapa's case is EB-2., if I am not mistaken. I am confident EB-3 I-140 cannot be approved unless PDs are current. I-485 cannot be files as such.
 
Retrogression Only Impacts Filing the I-485 / Obtaining the IV

Advance Parole

Hi All,

I know this may not be the right forum to ask this question but since it is one of the most active forums so I decided to ask anyway with the hope that some one will throw light on this.

I have a unique situation. I am currently on H1B which is expiring in December, 2005 and will be applying for EAD/AP for my self in about a month.

My daughter is currently on H4 which is also expiring alongwith my H1B and is currently in India.

My question is:

- Whether I can apply for Advance Parole for her while she is in India?
- Whether she can come here on H4 before it expires and leave again with the
Advance Parole (assuming it will be approved by the time she plans her
trip)?

Is anyone in this situation before?

Any inputs would be appreciated.
