My short journey to get the LPR (GC) is coming to an end.

1. I started with J1 as a post doctoral researcher in 1998.
2. Went on to H1B (6th yr ends in May 2007),
3. filed EB1-OR in end of march 06 and EB1-EA two days later. Both were
approved (self filed both cases).
4. could not apply I-485 due to Retrogression.
5. Filed I485, Sept 2006. (self filed)
6. Approved 2/7/07.

Thank you all. This is a great forum. You can find answer to almost everything you need to know about immigration and much more.

I will also like to add, please have faith in the system. It works. At no point I had to make any enquiry. And, I am not a noble prize winner. I am one of you. So it may take longer for some of you for the reasons sometimes difficult to understand for us (we may not be knowing every aspect of everevolving immigration system). But you all will finally get approved sooner or later. Keeping faith in the system will certainly help.

Filed in May 2006

Hello Everyone,

My I-140 was filed in Texas on May 2006 and there was no approval from USCIS.Their processing time passed my receipt date so my lawyer initiated the phone enquiry and they asked us to wait for 45 days.It has been four weeks now and there is no change in LUD.The online status says "Case received and pending".I am already on my 7th year.What should I ask my lawyer or company to do further?
 
My I-140 is pending since early June 06. My attorney contacted TSC and got to know that I-140 is pending for investigation. All of my colleagues (I know at least 10 of them) applied after me, got their I-140 approved. Not sure why my case was under investigation.

I requested the attorney of my company to apply for Premium processing and I paid for premium processing. However, attorney yet to file for premium processing. Maybe they will do this week.

Company attorney told me that if I-140 is pending for security clearance (aka, name check) then it is unlikely that I-140 premium process will to approve my case. However, I took the risk for premium processing and paid for that.

I will post the update here in this forum once I hear back from USCIS on my I-140 premium processing,

You might also consider to file for premium processing and see if that help to get our I-140 approved.

I do not really know. Got an e-mail from USCIS automated system.
Since I am in EB-3 I guess there is still a long wait. Best luck to everyone!!!!!!!!

Job change question

All Gurus,

Following is my scenario…..please advise……..

H1B visa period – Oct’01 through Sep’07 – 2nd renewal will expire in Sep’07

PD – Jan’04
Labor certified – Dec’06
I-140 applied (tsc)
Category – EB3
Country – India

I am currently working in company A. There is a possibility that I may get an offer from Company B and they might sponsor my visa. My question is –

1. Do u think it would be a wise decision to switch to company B because there are hardly 6 months left on my H1B?

2. Assuming that my i-140 gets approved and then I switch to company B. What happens if company B does not file my labor in time (i.e., before Sep’07). Do I have to leave the country?

3. I am hoping that Company B is willing to file my labor in EB2. Do u think it is advisable to go with EB2……because if my I-140 (previous company) is cleared, I can probably use the old priority date. Does that make sense or will it be helpful.

FYI - Got I-140 approval today. Details in signature. No LUD since initial receipt date until approval notice.

What is the outcome of your premium processing? Have you filed PP yet? Have you heard anything?

My i-140 was pending for a while too. It took 7 months for adjudication, after inquiries by me and the Senator. At the time, USCIS had indicated that the delay is caused by the "background investigation". So it seems that your case is similar to mine.

Where you required to do special registration in the past? I was.

Changing jobs after I140

If i change employers after I140 is approved, can i still maintain the old priority date with the new employer. also do i have to file for labor/I140 with the new employer?

Any input is appreciated.

You may change job and have your new employer apply for new LC / I-140. When these get approved, you may port the PD of the previous LC. Please note that the above assumption is valid as long as your previous employer does not revoke the I-140.
 
I guess my attorney filed the I-140 more than 3 weeks ago to NSC (Nebraska). I have not heard anything after that neither form Employer nor from attorney

How much time to get the receipt for I-140?
Mine is regular processing EB3.

I got labor approved from Dallas last week of January. It is CA SWA EB3.
Where are the most of the cases from California-SWA-EB3 processing? Texas or Nebraska?
