Simple, look at your LC. What ever your position minimum required, that is the deciding factor fro EB-2 or EB-3, not what you have. For Ex you have Phd, but your position require just High school. Then your LC is going to say High School as required qualifiaction. That is the decideing thing rather what you have. I hope it helps.

Counting exp: Before join this company what is your experiance? That is the exp, you can't count your exp with this company.

One more question, when taking about the EB3 visa retrogression,is the priority date referring to the time when my Labor application was received or some other date?

Date stamp on LC Application, when your state received your application, they put date stamp. This is the PD.

I just got my labor approved but have not yet received the approval notice from the DOL. According to my lawyer, they will not be able to file my I-140 and I-485 by December 31 if they don't get the approval notice (which I haven't yet). Is there a way for me to get out of this situation? I'm really desperate now. Any help is appreciated!

Hi duck008 what was your RD date. Just I would like to know how far they are now. Thanks

I wouldn't be too much worried. Remember that this is the holiday season, and things move pretty slow since a lot of people are on vacation. Keep your hopes high and fingers crossed.

My Status @ DOL Boston??

My data got entered into DOL Boston systems on Oct 26' 2004 in RIR category. Does anyone have any status update for Boston DOL?

I called the AVM and got this information. Whoever related to these case number, if not known the status earlier, please call and recheck once again.
It looks for other western states and seattle they process 5/24/2004 RD cases. I post this information in this thread, as I don't know which state these numbers are related to in SF DOL.
