To count for EB2, you need at least a masters degree or a Bachelors + 5 years of experience. My question is: how do you calculate this 5 years. Or specifically, do you calculate it at the time the Labor certificate application is file or I-140 is filed?
Simple, look at your LC. What ever your position minimum required, that is the deciding factor fro EB-2 or EB-3, not what you have. For Ex you have Phd, but your position require just High school. Then your LC is going to say High School as required qualifiaction. That is the decideing thing rather what you have. I hope it helps.
