Yes you can do it or else look at your job advertisement.

The job advertisement says 4 years + Bachelors. However, when they filed the LCA, I already had 7+ years of experience. Does that still mean that I don't qualify for EB-2?

Good luck

Please let us know when you get the LC. I am trying to find, how many days it taking to reach the actual certificate.

Prepare all your documents and talk to your Attorney to find out what you need and good luck.

I am sorry to say this, It seems you are in EB-3 Q.

It doesn’t matter what you have. What that job requires minimum. Don't feel bad. If everything goes well you get your LC, by that time Visa Cut-off date may move close to your PD

GCin2005,
Are you sure about this or is this just your opinion?

Consider this case: A person has a MASTER's degree and he is selected for a job who requirements are "BACHELOR's + 4 years of experience". Does that mean that this person who has a Master's will still fall under the EB-3 category?

Jayjo: Any comments on this?

Thanks gp111 for the information. Your answer cleared up the doubt I had.

Another question for you gurus:
I haven't been to India for more than 3 years, and I was banking on the Advance Parole to visit sometime in 2005. Now that it's clear that I probably won't be able to get my Advanced Parole in early 2005, I will have to continue on H1-B extensions (I am on my 8th year extension right now). If I go to India, then I have to get my Visa stamped in Mumbai - my Visa has expired two and a half years ago. And I have been told that it's taking upto 6 months for the US Consulate to approve Visas - something that's clearly out of question for me at the moment. Which means that I don't have a choice but to continue to stay in the US till I get my Advanced Parole. Since my priority date is November 2002, and the State Dept. is currently processing Jan. 2002, I believe I am stuck for another 3 years. Do you concur with my belief? Or do you think they will process it faster than that?

So my question: Can you guys think of a way for me to visit India in next six months without jeopardizing my return to the US?

Thanks a lot to all of you!

You can take web based appointment from consulate(I know Madras, you need to check the Mumbai consulate website) and then directly go on that day, usually they send your PP with Visa less than a week. I highly doubt that six months wait for H-1 Visa! I could be wrong check with other folks. For Madras 3 to 4 weeks is the max wait time.

Thanks for your prompt reply GCin2005. As soon as I receive my 8th year extension, I will check out online when can I get the earliest appointment. Hopefully, it will work out. Keeping my fingers crossed and wishing good luck to all of you....

Thanks!

H1 Visa Wait time in Mumbai is just 10 days.. You can check Latest Visa Wait times on State Department website (http://travel.state.gov/visa/tempvisitors_wait.php)..

Great! But that's only one aspect of it. The last time I heard of it, somebody told me that they now do some additional background checks after the interview, which takes between 4 to 6 months.

Only if you have travelled/recided in Middle East/Pakistan/Bangladesh in last few years.

Thanks a lot. You guys rock!
