EB-3 PD date as of to day is current. From Jan 2005 it could retrogate to sometime back to 2001/2002 for indians and some other nations.
 
We are into May 6th.

10% of cases from March to now is still pending?

I looked back up to mid March and found around 10% of the cases not processed to date. These cases are spread, every day some cases are pending. Those cases may be from other than Seattle region (and other than CA)?

Where can I find more information on this? My RD is June 02... Do I stand any chance of getting in before Jan 2005 assuming my Labor Certification gets cleared in next couple of weeks?

Jayjo, upon DOL certification status on the AVM, how many days did it take to your lawyer/employer receive letter from US DOL about such certification ?
Did you lawyer/employer took action to file I-140/I-485 based on the AVM status, or did they wait for the letter to arrive to start the process ?

Hello,

DOL certified on Nov 9th and my lawyer office received the letter on Nov 15th, I collected all the required documentation prior anticipating my case will be certified soon and Lawyer office start working on the form immediately after receiving the letter

Dang! Looks like I might be screwed.

Few questions that I'd like to get answers to:

1. Who decides whether it's filed under EB-2 or EB-3?
2. At what stage is this decided? When the LCA is filed or during the next two stages?
3. If it is during the later stages, what are the qualifications required for filing under EB-2? I don't have a Master's but my experience is 7+ years with a Bachelor's degree.

When we apply I-140 we decide based on what we have filled on LC.

LC is the main one. Once your LC states for your job requirement Masters or BS with 5 years min exp, then you can apply for EB2, if it is BS then usually EB3.

It is not what you have. What the LC filled (with min requirement).

I am sorry I am like you.I come under EB3. I have more than 5 years exp.. no use I am EB3.

Not a problem with your thread. But every time we need get into seattle thread and go for our western states. Instead I created the western states thread even under US DOL Trackers for Labor Certification. :)
