Did you get a chance to check the status they updated for NON-CA after Dec 7th. My number is 9583393. If I try some numbers close to this all numbers goes before dec or Jan. So I don't know how to find the closes number to my number for the RD after 5/10/2004. I found that you have updated last week upto Dec 7th, which they ceritified upto May 10th. My RD is May 24th. Can you please help. Thanks

Conflicting information about the recent retrogressions

Friends,
Please help me understand this scenario vis-a-vis my H1-B extensions. I've been hearing conflicting information regarding many things:

1. If I receive my labor certification in a couple of weeks and my attorney manages to file it before Dec. 31, 2004, the retrogression won't apply in my case. Some people I've spoken to say that this is indeed true, while others say "NO" - retrogressions will still hold for me.

2. My PD is Nov. 2002. If I am stuck because of the retrogressions, I will still be able to file my I-140 and get advanced parole. Some of my friends say it's correct, while others dispute it. Who is right here?

3. Irrespective of whether I am able to file my I-140 or not, I will NOT be able to get further H1-B extensions once my labor certification stage is over. I am being told that the H1-B extensions were meant for only those people who had their labor certification pending for more than 365 days. Does that mean I have to leave the country when my H1-B (now in 8th year) expires?

Thanks for your help again!

1. Even though if you manage to file with in Dec 31, because your PD is Nov2002 they will not process your case until the your date becomes current date

2.You can file I-140, but not the AP as AP should be filed with I-485

3 - Not true, you can still file for Extension for one Year

Thanks a lot Jayjo. It's really good to see you still posting in this forum. Thanks for everything you have done.

BTW, are you EB3 or EB2?

12/14/2004 PERM Cleared12/10/04

The White House announced in the dawn today that it cleared the long-awaited PERM final regulation of the U.S. Department of Labor. The exact date of release of this regulation in the federal register is unknown and left to the DOL, but it may not take too long to release this regulation. The Chief of Foreign Labor Certification, DOL, previously stated that once the regualtion was published, it would have 60-day window period of time before the PERM program would be actually launched. Now, PERM is reality and no longer the subject of speculation.
The current labor certification system of RIR, Limited Review, and Regular labor certification applications will soon disappear and be discontinued. The National Processing Centers in Chicago and Atlanta will go into full operation of the new labor certification applications named PERM as soon as the 60-day window is opened. For the development of this news, please stay tuned to this website.

Since I don't know where to post this question and there are so many people in this board that know much so I decide to try my luck. Your answer is appreciated.

To count for EB2, you need at least a masters degree or a Bachelors + 5 years of experience. My question is: how do you calculate this 5 years. Or specifically, do you calculate it at the time the Labor certificate application is file or I-140 is filed?
