hi,

i'm in 7th year of h1b visa, and labor certification
is pending more than a year with state. i've couple
of questions regarding job change:
1. can i change job, from company A that have filed
labor application to another company B?
2. with company B, will i get my yearly h1 visa extension?
or do i have to have a labor application from company
B pending more than a year to get yearly extension?
3. is there a way out? company A is closing down in 3
months.

thanks in advance for answering my questions,
Bala

As long as Company A does not withdraw your LC, you can change to any company and get the 7th year extension.

As per the AVM and somebody checked with SF DOL, the other state cases (AZ,NV,etc) have not been transferred to BEC. FYI

Yes you can change your job. I met a person, who was fired from company A and then joined company B on the 7 the year extension H1 (on the labour filed from company A) ..

Is it a Ca case?

Hi dude123

Hello
Yes I have filed from CA. I have recieved a copy of the letter from my lawyer. My lawyer has a typo in her email that the letter is from Texas. The letter is from PA not from TX.

Hope this helps. By the way, anybody in this forum knows or have any idea, when the BRC's going to start approving the LC applications?

Thanks

Hi dude123
Thanks for your prompt reply and a very happy new year to you.:D

BEC 45-Day Letter Tracking

Hi,
I think it is a good idea to track the PD date of the California cases who have received BEC letters.
Those who have received letters from BEC, Please reply to the message.
I will compile (Edit) my post to reflect the PD Date that received a BEC letter.

JRFF,

That's a good idea, and thanks for taking the initiative.

I understand that the BEC letters are generated in the order they were input into the system, which happens to be Local Office received date (= SESA receipt date for CA = PD). In most cases the order of RD and PD will be the same, with RD = PD + around 11 months. I feel tracking it by PD (and mentioning RD also) will be very useful.

Thanks again!
