My lawyer replied in Mid October for four 3 option letter cases all at same time, one got approved in 1st week of Nov, second case got approved by 2nd week of december, no news about two other cases yet, no cryptography can decipher the pattern of processing.

yes, we received 2 approvals so far, after replying for 3 option letter.

I am also on the same boat mine was sent on Oct 12 th 2004 no reply yet...could you please send the possible draft of the response sent to DOL, did you retest the market and what was the response (eg no response found etc.).

Dude could you confirm your state such as ca/AZ/nev etc.
It would be better to track if the state is mentioned with PD dates.

So far from the threads it looks only texas/philly have recieved BEC letters

I am from CA and received the letter from PA BRC. I have already mentioned this in my earlier post.

BY the way, GP111 or any GURUS of this forum has any idea when the BRC's are going start approving these applications. As I am asking this question 3rd time, please share your thoughts.

dask_1, mine was sent in early oct. My lawyer told me that they didn't retest but sent the hiring record of the company for the last 6 months. There was a lot of hiring done. What did they do in your case?

I don't have the draft with me, that's something attorney did, but what we did was, restested the market by advertising in news paper and waited for 2 weeks for any response and there was no response. Lawyer filed as such saying no response for four cases, two got approved and two other no news yet. It looks like they accumulated the responses in a batch by the officer who originally sent the 3 option letter and since those officer's are gone they are being reassigned each batch to existing officer.

There was some confusion earlier regarding the transfer of cases from SF region to BRC based on an article in murthy.com. In that it says cases from jun 03 to sep 04 (receive date) were transferred out to BRC's, but the vioce message at SF Region says May 5th.
May be all cases from May'03 to sep'04 (including both months) were transferred out.

I was surprised to see LC certified on 3/27/2003 dates. Am I in trouble?
 
I-140/I-485 filing

I have a couple of questions about this. This thread may not be an appropriate forum for this discussion. However, I'd appreciate any information you share on these issues.

1. How does I-485 retrogressing work? Consider scenario 1: LC approved Jan'05. I-485 _not_ current. I file I-140. In Feb'05, I-485 becomes current. Can I file I-485 immediately, or have to wait for I-140 approval even if I-485 date is current. Remember, had I filed concurrently, I would not have been required to wait for I-140 approval.

2. What's the status of concurrent filing? Is it still being done? If it is, is it my choice whether to file concurrently vs. separately?

Not necessarily. It could be as simple as the clerk who is processing your case is on vacation for 2 weeks.

I'm not gp111, and definitely not a guru; but I'd read something about this in another thread, so I think it might help.

I understand that once BEC receives the letters in return, they have a team which will start processing the applications, again maintaining the same order (PD) used while sending out the letters. I understand this team - which will look into your application - is currently also used to help generate the 45-day letters, but once BEC starts receiving the 'YES Continue' letters, this team will be pulled in to do the certification task.

At least, that's the plan as was discussed in the "BEC Philadelphia" thread (http://www.immigrationportal.com/showthread.php?t=149224&page=6&pp=15). With DOL & BEC, you never know !!

I just sent email to my lawyer. She said we recieved the letter. I dont know the details of the letter yet. I dont know where it came from. I will post as soon as i got those details.

1.I-140 can be filed which has no bearing on retrogression.
2.When I-485 becomes current,based on I-140 reciept you can file I-485 and no I-140 approval is required
3.Concurrent is still valid
4.By filing concurrent I-485 does not get approved untill I-140 is cleared.
other benifits are you and spouse get EAD,AP, and after 180 days of I-485 filing you can change the employer if I-140 has been approved.

My Case# is 09553812. There are about 10 cases 09553807 to 09553815 that have Mar-24 receive dates. Most cases that have 095538XX have Mar-31 receive dates. I am confused by this as well. Anyone know how this happens? Also, are case processed by date or by case #?
