The step you should fallow is obtain Non availabelity certificate from your palce of birth municipal/carporation ( English). Then you should make an affedivit by two of your relatives who are aged more than you (if parents not living). formats are availble on websites.(immihelp,etc.)
Also a note , it is safer to have an affedivit if there names are not included in birth certificate which is normal for Indians.

Incidentally, there are two other threads started by gp111 - one for BEC Dallas and another BEC Philly which you may find useful once you know which BEC your case is in. Let this thread continue as the CA DOL thread.

Question

My PD is Jul 2002
RD is May 2003
CA RIR case.
Why I haven't received any letter (attorney).
Any one in the same timeline received anything.
 
If you have received the 45 letter, please respond (Second Attempt).

Can the folks who have received the 45 day letter please let us know if both the attorney and employer have received the 45 day letter ?

Four pages:
Page 1. explaining the process, deadline to respond, etc
Page 2: Enclosures (just a list of things enclosed with the letter)

page 4: "Selection of Continuation Option Letter"

I also see a new case number, it says "ETA case number: D-xxxxx-xxxxx"
(D for Dallas may be?)

In my case, both my attorney and my employer got the same letter.
 
BEC Letter

Hello!

Just heard from the lawyer that the BEC letter from Dallas was received onthe 3rd of January. Haven't heard from HR whether they received a copy of the letter. Here is the info.

Corrections required:

Alien's Birthplace is a required entry.
Employer Address offering the job is a required entry.

Case info.
PD: Dec. 12th, 2003
SWA sent on to Regional: Sep. 28th, 2004
RD: Nothing received from Regional
Case Location: CA
BEC: Dallas
RIR/non-RIR: RIR

If we were able to receive the BEC letter who's going to sign? attorney or I should bring the letter to company's H.R.

In my case my employer retested the market and disqualified the responses based on the requirements. I don' t know whether labor will get approved or not.....it is almost three years since my labor was filed...this is just too much man.... :mad:

45-day letter from BRC

Dear friends,

I finally saw the 45-day letter (lawyer office scanned and sent it to me). The letter has 3 parts:

1st part/page : Letter from Dallas BRC officer letter to the employer stressing the need for "45-day" reply timeframe. The letter has to be replied within 45 days. (In my case the letter was dated December 29th and my office shd respond before Feb 5th). Most importantly this letter does not have anything abt my received date. It has only my PD date-August 2002, Job code, name. So this means they are going by PD ONLY.

2nd part/page; Any corrections to the orginal ETA forms A and B can be made here. They have to be listed point by point. If no corrections, it should say none.

3rd part/page: This gives two options for employer; to continue with current petition or withdraw.

My employer will sign have to sign and sent it to lawyer who will forward that to BRC.

Hi dask_1

If your case is from CA, you need to ask your attorney to check your case status with the SF DOL. If your employer has touch with your attorney then ask your employer to inform attorney to check the case status. Currently SF DOL is processing March 2003. So either you may get your case result soon or you need to check the case status. If your attorney request the case status in SF DOL, they will provide the information defintely. Please try this instead of worrying on this.

Can your attorney sign the 45 letter or you should bring the letter to your H.R.? because from the previous post I ask and there is a response that the attorney can sign the 45 day letter.
 
Can any body confirm with your attorney's what is cut off date at SFO Regional office for RIR cases.

I know it is May 2003 (RIR) or later are transferred to BEC but my attorney insists it is July 2003 or later as per his info.

To justify his statements BEC letters have been recieved for month of July at his office and unfortunately not for May 2003.

Is it a just co-incidence that they processing on LIFO and some people having RD May 2003 have to wait in SFO for a long labor.

Does somebody have the similar problem of not having recieved these letters for May and june 2003 (RIR) cases.
