EB2 or EB3!!!!

Thanks a lot for your work in this forum.

I have got a similar question that you answered today.
Here is my company add regarding my case,

"
REQUIREMENTS:

A Masters, or foreign academic equivalent, in Computer science, Computer Engineering or any engineering fields, plus 3 years experience in job offered in software design, development. Experience must include network and unix administration also. Employer will also accept a BS + 5 years of experience in lieu of MS +3 years of experience."

I am little bit confused whether my case will be under EB2 or EB3.

When I apply for the Job I was having BS + 6 years of experience . I have got 6 year experience letters from my previous companies.

Please clarify me.

You should be able to go for EB-2

All SWA/SESA office will transfer the cases to BECs by Mar-05 ( cases with PD before 1/1/03 will go in first batch & remaining will go in next batch)... Again this schedule is for SWA not DOL.

Thanks GP111. That helps a bit. I'm assuming that there's no new info on the cases transferred from SF DOL to BEC (Dallas/Philly) yet!!

PD Date Cut off

EB2 still current as expected

EB3 for India, China and Philipines cut off is now 01 Jan 02.

gp111, isn't this a bit too drastic? Everybody expected it to be mid-2002...

The Visa Buletin got published yesterday.. You will find lots of talks about that in earlier posts all the threads !...

Yes its bit tooo drastic.. but more scary part is as per murthy.com... it can still retrogress further !

btw, would you consider the Eb2 to be safe for now from retrogression or has that also retrogressed in the past?

Good Question.. I have been looking for answer for long time now (being EB-2 myself !).. Answer I got the most is "It may retrogress but not as back as Eb-3"

3 option letter reply

According to my lawyer, they laid-off some officers in SF DOL, at least the officer on my case is gone. Seems a lot of re-test didn't get result after long time waiting. Did anyone do get approved after re-test this two minths?

Here is what my lawyer replayed to me about letters from BEC

There have been several delays in this process. However, the first batch of 10,000 notification letters are being sent out by the BRCs this week. These 10,000 cases most likely represent cases that were filed earlier than yours and are still pending, but we know now that there is movement and hope to see similar notices for all cases.

The following is the latest announcement from Monday:

DOL HQ has advised that they are planning to do an "initial" run of approximately 10,000 Center Receipt Notification Letters from the Backlog Reduction Centers in Dallas and Philadelphia the week of December 6, 2004. These are the letters with a 45 day response time. As a reminder, we were previously advised by DOL that an untimely and/or incomplete response could result in a case being closed.

The attroney or whoever placed this ad is very knowledgble. The trick is he has clearly mentioned in the ad equating Ms+3 = BS+5 in your job requirement.

eg. if the ad casually mentioned MS+3 and not equated then you should have 8yrs.

So the point is that ad placement (job requiemnet in form ET750) is very important
