I wish and hope and pray and......... that as soon as we are done with 2002 , processing for 2003 goes faster - atleast a month for a month if not better - Just being hopeful - hope doesnt hurt !!!

Hi,

Please help with my situation as I am very confused.

I have MS+5 years experience. However, before joining my current company, I have only MS+6months experience. My RIR was filed in 2001 with requirement as MS+0. When it came for retest, my company people chickened out and didn't send results of retest since there were couple of resumes that had MS.

Now, the application is remanded and back at SESA. Now, I have a dilemma, I don't know whether I have to withdraw and refile with MS+6months requirement or just stay with the remanded application. I have to take a decision right now because my H1 6 years complete in Oct 2005, so I have to file a new one before Oct 2004 if I wanted.

I heard about backlog reduction centers, will they look at remanded cases (SESA), or only DOL cases?

My case was filed on 05/15/03 with from Sacramento, Now the cse has moved to DOL on 04/29/04 , So from what I understand my PD was - 05/15/03 & the remand date - 04/29/04 , Please correct me if Iam missing something here. My case is EB2 RIR

04/29/04 is your tansmittal notice date & you will get a receipt from DOL with received date (RD)... believe me, you don't want to get remand date !!!

I'm in similar situation. I'm not sure what Backlog Reduction Centers are supposed to do. But either ways thaty should help our case if they can knock off some big blocks which are in front of us. I'm not sure if it's better for you to withdraw the application and file a new one. Is your company giving you that option ?

7th year H1B extension

When is a person eligible to file for the 7th year H1B extension ?
Is the person eligible when they have filed for labor or when they have an approved labor ?

Also what factors determine a case to be EB2 or EB3 and what stage of the GC process is it determined ?

MS + 2yrs

My company also has an Office in Wisconsin and we filled a second application from there.
Received an RFE there to prove the 2 yrs experience. and replied back.
Now I am in a dilema, I I should go ahead and file the 140 from CA or wait to see what happens with Chicago DOL and file from Nebraska.
 
Auto remanded cases

Hi,

Have any of the auto-remanded cases after June'03 been approved
or received an RFE?
The queue is hardly moving for these cases.
 
What is AVM saying this Monday? I called many times but it kept on ringing with no response. Did anyone get a chance to call ? If so is there a progress?
 
DOL is still processing July 2002-Dec2002. According to my lawyer they should start Jan 2003 pretty soon.

(415) 975 4617 for individual case status.
 
Thanks for the reply, I still have to work with my company, but they may be willing to do it. But, my dilemma is whether I want to ask them or not. Can anyone help me here? Thanks..

Under the Twenty First Century American Competitiveness Act (AC 21), you are eligible for indefinite yearly increments of renewal of your L1 or H1 visa only if you have evidence (normally the one page receipt letter from SESA) documenting that you filed your labor application with SESA or DOL prior to the expiration of the fifth year of your work visa.

On another note, there is a loophole in this rule as follows that the INS has not been clear about:

You file labor certification with company A prior to the fifth year expiration and request a remand which should take forever to get processed.
You transfer to company B and file another labor application and renew your work visa based on the fact that you have a pending application with DOL even though it is not with the same employer. I have not seen anyone do it and my attorney does not know the answer to this situation. Ideas are appreciated for those of us who are stuck with an employer because we have a pending labor certification application.

EB1 normally stands for Ph.D or outstanding researchers.
EB2 normally stands for people with exceptional abilities or a masters degree
EB3 All others.

Does this mean that cases which have errors or some issues will be remanded to state without being given a chance for RFE ? I am confused what it's talking about. Does it even apply to Labor certification or the later stages of GC(INS) ? :confused:

When talking about backlog reduction centers, Is it for the DOL part or State part ? Anybody know if anything is going on with it or it's just talk.
