its true. I was told that DOL will not pick up the cases where they were given the 3 option and employer choose not to re test.
Those cases will be processed as non-rir.
 
DOL Receipt Date is on 01/13/2002

I am a GC holder and my husband works for a small stable company in Bay Area.

My sponsor does not help him much. I am just waiting for him to get his LC which atleast will give is some hopes.

Any inputs as to how long we should wait? a year? Few months?

I understand there are people who are waiting from years together and I wish they all get theirs soon. I just wanted to get an idea.

Hi,

My RD for DOL was Nov 12, 2002. The DOL had requested additional info from my company [very large Bay Area firm with layoffs, but quite a lot of hiring too]. My company had sent the info to the DOL in late Dec 2003 which was 3-4 of weeks after after they got the request.

My lawyers haven't heard from the DOL yet. Any idea how long the DOL takes to get back with a decision? Since they are already processing Dec 2002, I'm anxious to know my situation.

As far as I know, no LC application from my company has ever been rejected. My DOT code is 999-113-021. The job requirement was BS + 10 years exp.

Our law firm has a couple of "old" cases for which the DOL has not got back with a decision. They have sent numerous inquiries (phone message, attorney liaison assistance, mail, fax, etc.) but have not yet got replies. I do realise that the DOL is overworked and I sympathise with the case-workers.

Any idea what one can do to help expedite the process? Is there a process of escalation?

For the 3 option letter which is the best way

1. Re-test
2. Re-apply
3. Withdrawn

I know only Employers who are really afraid have used the
thrid option. Can you not re-apply puting a BS+3 (if qualified) or higher if the lawyer had earlier put BS+0 or BS+1 and what
are the chances of approval since these new rules are
so dynamic and distrubing where people suffer due to
lawyer's mistake and new rules. They should have made
the rules to the present applications rather than the apllications
pending in DOL.

If the I-485 primary applicant were to die during AOS, all dependents would lose their legal status in the States immediately.
If you were to die before approval, your loved ones must suffer from legally difficult situation in addtion to your death just because of USCIS processing delay.

The latest check on AVM shows my case still remanded. Only the remand date is now October 20, 2003 and the recording time seems to be October 7, 2003. I never heard the message "Case moved back to DOL after remand". As per carlson memo my case is eligible to return to DOL after remand.

Dont know what to do. Anyone else with similar situation?

My case was remanded in April 2003. The AVM still says "remanded to State" . Lawyer says DOL wiil take some more time to get to all the auto remanded cases

Hi all,
Just checked.. AVM is unchanged. still says they are processing RIR apps between July and Sept 2002.
Happy Ugadi to everyone... ( Ugadi is a south Indian festival which heralds the arrival of spring and a new year according to the Hindu calander ). Lets hope this new year will bring us all good luck especially on the Labor/GC front.

Hi Everyone:
I am so glad to report that my labor certification for 999-113-021 Information and System Manager position has been approved on March 19, 2004. I heard this on DOL voicemail, and I am taking it seriously! My DOL RD was Dec 3, 2002 and prioirty date was Nov 21, 2001. This took the whole process to last about 40 long and enduring months.

My company is a small and startup company in Orange County. I hope that all those in waiting get the same voicemail soon.

Just got the news on the AVM -- Certifed,

So Long, So Frustrating, from one queue to another long waiting queue, we are modern slaves, whipped by these documents, we left our free country, to be bondaged by these laws,

What are we asking for is just independence and freedom so we and our families can live happily, and not be messed in these political situations

Certified in pain as if we begged for it, we deserve it more, coz the revenue we generate is in millions

auto remand question

Hi guys,
My case has an original DOL receipt date of 07/26/2001 and was returned by state after a remand on 12/05/2003. Does my case now goes to the front of the queue or it will processed as if received on 12/05/2003. I am asking this as the current processing time is 12/2002 and I haven’t heard anything from DOL.

Your case will go in the front of the queue, however based on recent approvals, I think DOL has started some parallel processing of the returned cases and the orignal cases.

Guys, we cannot let DOL take the employer remanded cases on the back burner. Something has to be done. I think that all the people affected by this particular situation should plan on creating an official petition that can be sent to DOL. Wasnt there something similar created for expedited 485 processing? I do remember seeing a link like that on this site.

Remanded cases status

Any update on Auto remanded cases. My case was remanded to state on 07-Aug-03. I just checked the status, it still says remanded to the state. Last time I heard that cases that were remanded on 14-Jul-03 have been approved. Any updates on remanded cases after that???
