Hello Hanuman,

Please look at my post earlier.
My case was auto remanded to the State in June,
When all the uproar about cases being reconsidered etc started , I called the SESA. The Lady asked me to ask the HR people to call.
When they called about my case the lady told them that under the new directive my case would be sent back to the DOL, but she needed a formal request in form of a letter from the company asking the SESA to resend my case to DOL for reconsideration.

I would advice you to call SESA yourself with your SESA case number and see what they say. If they are not willing to give you information please have your HR people call and find out. Ironically my Lawyer did not know about this. I found all this out by myself and due to this Forum

To NkelKar,

Could you please let us know what's the SESA no. you called and is that SESA case no. is the original SESA assigned no. , or need ask them for the new one since the remanded?

The number I called was 916-464-3400 and I gave them the original SESA Case number which in my case was 1393xx
 
Hi nkelkar,

Even i checked with that number.But that lady is telling the database is not updated!!!.Any suggestions!!!!

I also checked my case status, initially lady told me you HR should contact but she checked my status after request and she said they are waiting for DOL next instruction.

Fax

Guys,

when you dial 415-975-4617, it gives 3 options. when you press 3 it says the info will be faxed to you.
But it never faxed. Did anybody get fax from DOL using option 3.

Hello Raj and Dev,

When I called I said to her that I knew my case had been remanded and that I wanted to know what was happening. She verified that it was remanded and told me to tell the HR people to contact SESA for further instructions.

The HR person who called is on vacation till Tues. But he had another HR person on the phone with him. She called me to tell me that they had spoken and that SESA had asked HR to make a formal request asking SESA to resend the application back to DOL under the new guidelines. She even gave HR the name of the person who they should address the letter to. The HR person who called me actually gave me the name of the person in SESA who the request is to be sent to, but I dont remember.

I will know the excat details on Tues and will update the Forum.

I appreciate your suggestion. My problem is i got NOF at DOL and
was replied in early june 03. DOL is just sitting on it. I asked my attorney to give my case number, standard answer its not your case but companies, so my company HR needs to request for me and i need to get from my HR. But HR will ask my manager why i want my case# and i don't want managers to get involved in this.

Anyways, should we all write a letter to DOL HQ (Fed-DOL) to issue guidance at there earliest as promised Mid Nov date is gone.

but where is the "guideline"?

If cases that were remanded to SWA are being sent back to DOL, how does one find out when a particular case will be sent back?

Can someone tell me how to go about getting the DOT code? And for immigration novices like me - how in the world does one get hold of a personal contact at DOL or SWA? My lawyers get fat money from my company and they dont care in particular to push my case or any others for that matter...so its time to take matters in my own hands...

For me no NOF.No 3 options.I think that auto remanded.Still now the AVM msg is remanded.

I got some kind of query at DOL level. And my attorney will not give details, i think they once said addition recruitment information is needed. Which i put as NOF.
 
Mine was an auto remand.
I was checking AVM everyday. It went from Received one day to Remanded next day.
I did not have any queries at the SESA level. Approved and sent to DOL from SESA without query
 
I still have not received any intimation from DOL as to when they received the Sesa transmittal. (was sent in August).
Can I send a letter to DOL to inquire or can be done only by my lawyer?
His reply was "Don't ask me as to when the DOL is going to send the receipt.When we get it we will let you know".
Is there any one else who has received any receipt August onwards?:confused:
 
Called SWA..

I called SWA and the guy who is handling my case was (as expected) quite rude. He told me that the information he was handling was confidential and he had no idea how I got my SWA number...

He also told me that based on an attorney's or HR's letter, DOL "might" ask SWA to return a case. But there has hardly been such cases is what he mentioned. Also, there is no such thing as auto-send the applications back to DOL as some previous threads have mentioned..at least thats what he told me.
 
Crazy_people,

That sounds pretty much in line with the conversation my HR had with the Lady at SESA. Although I must say that the lady I spoke with was very nice and courteous.
The Lady told the HR people that they had to send a letter to this person and then they will send my case back to DOL.

My company also has filled cases from Wisconsin. I spoke with the SESA people there and they were rude.
 
By the way, what's it with these lawyers ? Why do they behave so snubbisly ?!! They simply don't seem to understand the pain we go through. The least they can do is talk politely. I know there are some lawyers who go out of their way to help guys like us. But they are only exceptions. For the most part, I have only seen lawyers and assistants with an attitude.
 
About Attorney

I am also in the same boat, I have choosen my own attorney, to file my grren card, I am trying to conatct this attorney last 10 days but still he didn't contact me.I paid him almost full GC fees and if I change my tone in email then he said, I can take another attorney . I don't know,why attorney behave like this after getting full money.
