People,

Its a great news that LC are now getting approved. I am sure everyone in this forum will appreciate if you can post details like :

Remanded Date, AutoRemanded or 3 options, experience, DOT code, any action taken by lawyer before it went back DOL....

Please post if you know any or all the above info.

Hi all,
This is the first time I am posting at this forum, but I have been reading it for the longest time, I think its really helpful. I would really appreciate it if some one from this group canhelp me answer a few questions. Firstly I am a Sr. Programmer Analyst at a fortune 20 company in San Francisco. My lawers would not share any information with me regarding my case, saying that the case is not mine, but the companies. I was wondering if some one can tell me under what DOT Number will I be. Second thing. I have filed my case under EB3 RIR. My case was files in Dec. 2001 with the State Labor Department, it was transfered to the DOL in Nov of 2002. Does any one know what is the status of teh cases for these dates, as far as I know, my case has not yet been remamded ( I Hope it Dosen't). I will really appreciate any feedback.

Please try 415-975-4617 1 & 2 then give your employer phone number and hunt for your case if you have date idea then you will get your case.

I have tried all options, My company is 25K people company and I really don't know what number they have used, I have tgried all kind of numbers including mine, Company's main number plus the number of HR Managers, but it dosen't work. I even tried the Lawers main number, but to no avail. Do you have any clue under what DOT I will be. I have tried to find the list of DOTs on the internet, but it seems like I cannot find any page with listings of DOTs starting with 999. Will appreciate any kind of information.

I would guess your DOT code may be on of the infamous -
999.151-031
999.151-032

If your case was transferred to DOL in Nov 2002 then the case may not have been processed yet as they have gone back to August 2002. Hang in there and hopefully in a couple of months DOL should process your case. The DOL email system (LCSTATUS09@doleta.gov) was very useful in identifying case numbers using employee tax id, but it has not been working for a long time.

I checked AVM and say it has been certified.
I didn't receive any paper yet after 14 days.
But my lawyer doesn't know anything about it.
Lawyer think my case is still in EDD (State as remanded).
Therfore laywer will call EDD and DOl and let me know by end of this week. If I get positive answer, I will post it again.
I am wondering this might be AVM error. (I wish not).
Without paper or any document what can I trust except GOD.

My history
EDD : Sept 5, 2001
DOL : AUG 12, 2002
Auto Remanded : Jun 10, 2003
AVM : certified Nov. 4, 2003

DOT 999.172-199 : etc engineer category (mine is optical engineer)
MS +3

My lawyer called EDD about my status last September.
Heard EDD cannot do anything except waiting minimum 1 year.
Obviously didn't contact DOL at all.

I know this is painful process.
I wish everybody get certified including me.

Thanks for replying, but please can you tell me why I cannot find any DOTs starting with 999 in all the DOT listings I have found over the internet. May be if you know any site which lists DOTs starting with 999, I will appreciate it if you can share it with the forum.

Adding my case detail

I just used the telephone number provided by the list and company telephone number and got the details of my case. Adding the case detail

Case status showed up in auto phone system

Just to keep everyone posted. My case finally showed up in the auto phone system 4 months after DOL received.

My case was transfered from SESA on 7/17/03. No info since then till today. Last time I tried to locate my case by employer phone number was 2 weeks ago, still nothing. Today it finalled showed up.

So, if you are in same situation, chances are that they are just slow. No much to worry about.
 
hi, one of my frieds' case has been applied at CA SESA on Dec 31st, 2002. Please share with us if anybody's case has en applied in that time frame and the status of the case.

They (the company) has to formally send a request to the SESA to send the Remanded cases back to DOL to process as per new Guidelines issued. Unless the company sends that request SESA would not resend the Remanded Cases back to DOL.

Do we have any "Auto Remand" case where status has changed from "Remanded ..." without attorny/company requesting SESA(EDD) to transfer it back to DOL?

And/Or

Do we have anymore case where SESA said that there must be a request to transfer the case back to DOL?

Please post.
 
Auto Remanded cases

Hi Guys

I spoke to one lawyer today( Not my company lawyer) and she advised me to get the Freedom of Information from DOL and SESA regarding my case through my lawyer.
Has anybody got FOI from DOL and SESA and if yes what are the pros and cons of doing that.

SESA letter shows they transfered it on 7/17. Phone message says they got it on 7/21. It also says something like "this message was updated on 7/21. " Don't know why I only got it now in November.

The phone number is 415-975-4617. I think I saw somebody asked.

There has been an ongoing discussion with DOL for several months now on how to handle LC cases pending at DOL or remanded to the State level (SWA). DOL HQ is now supposed to issue a policy guidance that will direct the Region DOL offices and the SWA’s on how to proceed with these cases.

Once the DOL guidance is released we will be able to make individual case assessments and plans. We expect that cases that are at the state level that are eligible for adjudication will be recalled or will be eligible for requests for reconsideration and adjudication. If DOL requires that requests be made for reconsideration, we will take action on individual cases promptly.

In the meantime, please be advised that the DOL examiners seem to be taking some action on some individual cases – there have been small numbers of approvals, re-advertising requests and direct remands. Unfortunately the sample is small and the details are too varied to constitute a pattern. Also be aware that there are many rumors floating around that are largely based on speculation and wishful thinking.

Our approach has been to advocate for the best possible policies directly with the agency, to be prepared to take action promptly once we know the agency’s policy, but to take action only when we know what the outcome of the action will be.

We hope that the DOL will soon make clear its policy and that we can take appropriate action. As soon as we have the DOL guidance, we will post information on our website, and we will contact HR and those individuals whose cases will benefit from the new policy.

We hope that this is helpful, and we thank you for your patience.
