Info on BackLog Reduction Centers

Some information on our lawyer's website (maybe similar info has been posted, if so, sorry for repost):

Sources have reported that labor certification applications pending at the Dallas and Philadelphia DOL regional offices are currently being transferred to backlog reduction centers that have been set up in those cities. When a case is transferred, a letter is sent to the employer and their representative advising of the transfer to the reduction center and also requesting updated information. According to sources, employers are being given 45 days to respond to these letters. Responses that are incomplete or are not received within the 45-day time frame will not be accepted and the corresponding case will be closed. We are following this issue and will update you as we receive more information.

After 2 weeks of silence DOL has move to March 2003.. As per AVM CA dol is now processing cases received between NOV ‘02 to March ’03… It is slow, but good news is Lots of people with 3 option letters got approved in last two weeks !

gp111,

Just the dates moving to March 2003 is not sufficient. There are lots of cases with RD in Jan, Feb'03, still in received status. Looks like they are still working on those cases. Don't know when they will be finished with those cases. I have RD of 02/26/2003 but status is still received.

Using Substitute Labor

Hello Friends...
I needed an urgent help regarding using substitue labor. I have currently my labor going on with my current company x but its so slow.....
My company had acquired company y and I recently came to know ... for my position there was an approved labor in company y. Now, everything pretty much matches up in that labor ... apart from the education.... They asked for MS + 2 years and I have BE + 2 years 8 months.
But somebody suggested to me that if I am able to evaluate my Degree + years of experience to MS... It might work!!

If any of you have knowledge or suggestions for something like this please let me know.

Thanks in advance

It takes 4 to 6 months to get receipt from DOL... You can check AVM with your Company/Attorney phone number & see if your case has already been updated in AVM.

what is the strategy of BRC?

what do u think r the strategy of backlog reduction centers? i mean ok now they will begin processing dallas and phili cases at the regional level, but what after those cases r finished? do u think they will clean all the backlog that is in all the states levels that r under those regions, or they will go to the other regional levels and clean them then they will begin choosing the most backlogged states and clean them nationwide?

regards,

Some Feb 28 Certifications..

9548471

BRC in general is ok. But there is no information on how they r going to process. It looks like they will take one region at a time complete and move to the next region. This is bad news for Cal. It will take a long time before they get thru Philli and Tx cases. Looks like ATL and CHI are next(based on earlier buzz from murthy.com)

therefore from what ur saying after finshing the regional level of texas and phli , next will be the states under the juridiction of regional phil and texas? if this is the case, the backlog center will not be in california region with its states before at least another 1 year. this means the people tyhat will be covered at last by BRc will suffer most from the eb cutoff priority dates because by then most of the april 2001 applicants of other states would have reached ins and DOS because dol cleared their states. man if this is the truth, it means we will not see te green card before 6 7 years!!!! what a silly system.

I still haven't quite grasped it... and the option to fax the status back to you doesn't work?

Employer chosen remand cases

Hi all,
I am again bringing up this topic of cases that were remanded to
the state from Regional DOL based on the employer preference
after a RFE was received. (This is different from the Auto-remand
cases).
Does anyone have any update on such cases ? Whats going
to happen with these cases ? Can we ask State DOL to
fwd these cases back to the regional office basd on the last
Carlson memo ? Anyone tried doing that or something similar?
PLEASE HELP.

Thanks for your answer. My attorney mentioned that in order to keep the old case while filing the new one, the job tile and description need to be changed. Have you gone through that?

i didn't understand what do u mean? can u elaborate?murthy link that u gave is just talking about regional not mentioning of rnay state level. can u explain
Antonio,
This is a very old article(Jun 18) before the BRC rule was published. I put up the link only to show that Chicago and Atlanta cases may be taken up after Phi and Dal (That was ur original Q).
We need to wait for some more time before we understand how this BRC's are working and how many cases they can handle in a month. We will know if they picked up cases from the region alone or from state as well.
