Processing time for green card based on asylum

Hey guys,

RFE was issued today after 2.5 years. Hopefully, that is gonna be medical.

The case was pending since October 2020.

Mandamus worked, so go ahead and file one!

How do we apply Mandamus. What are the eligibility criteria to file for one? Thanks in advance!

this is so unfair and absurd, I am so sorry for that. It's ridiculous.
hopefully hopefully you will get it soon, and hopefully (times 3) it will be backdated enough to compensate for this time you lost and be able to apply for citizenship soon enough as well - I am giving them the benefit of the doubt.

if you're doing it through marriage, you will get a conditional green card for a couple of years. you will need to establish good relationship/rapport with your spouse during those two years and then u submit an application to remove the conditions, then 2 years after that you can apply for citizenship. he will be your sponsor and your green card depends on him.
if you do it through asylum, your green card will not be conditional and it will not depend on your husband. you will be independent ;)
you can choose either - my advice is to ask an attorney. personally, i will not depend on someone to get me a green card. getting a green card through asylum/AOS and by myself is better, and much more free and independent, in my opinion

I have a question, my i-693 (medical) is getting very delayed because of certain vaccines that I’ve not received before and I couldn’t submit my i-485 because of this . Is it best to post the i-485 and wait till they send the RFE for medical?

Yes, at least you will be in the queue. I think it would be best to apply without medical
 
How long will it take them to send the RFE and won’t my i-693 expire?
If you don't have the I-693, send the I-485 by itself for sure. The medical expires within two years so you have a lot of time. Also, by the time they issue a receipt notice and start processing then send a RFE, you will have had enough time to take the vaccines and complete your i-693.

As for how long it will take them to send the RFE, there's really no way to tell. They are moving faster than before (within 6 months or so) and they "usually" request issue a RFE when they are close to making a decision, usually 2-3 weeks before they make a decision, but again there is really no benchmark. Thank you for the information, but I already paid for the civil surgeon and did my lab works. I am only waiting for certain vaccines (covid second dose and hepatitis b second dose) . I am worried if my lab results will get expired until they send me the RFE.

they won't expire by the time they send you the RFE :D no worries - even if you paid or didn't pay the civil surgeon, it won't affect the timeline since you have two years :D

Thank you and appreciate it. I read the same in i-693 instructions too. Will wait for RFE . How long does it take them to send the RFE?

Nobody knows. It really depends on a lot of factors we don't know. For the application decision, the processing times are within 6-12 months and they keep updating them with shorter times. Usually they send the RFE a little before they're ready to make a decision, so it might take them 1 month or 4 months or 10 months, but very very rarely are they going to wait 2 years to send you the RFE - they are being much faster than previous years. What you can be certain of is that you have all the time you need when they send the RFE - whether you already got the rest of the shots or not, it doesn't matter. You have all the time and you won't be late because they're much faster now.
