I read the message you recieved back from DOL. Usually one gets that message when there is "syntax problem with mail" or "case is not in their system".

Philly DOL had entered cases into their system within a week in past. They might be lagging behind these day's with increased # of applications.

Regarding calling Philly DOL, don't tell your employer. I haven't seen or met any employer who will be happy to know about it (unless you guy's are very close). If you are planning to check your status with Philly DOL make sure they don't even get a hint that you are an employee. Call them as if you are employer.

Hi all,
I checked with Philly DOL, and I got back a list of cases, for my company. However, I do not know my case number, so I have to guess which application could be mine. Now the thing is, from what I am looking at the one closest to my date Philly DOL RD -09/27 is definately Not me...(as evident from the other details), but the next case (Philly RD=10/15) could be me(the details match). Now in this (unfortunate) guessing game (as I do not know my case number), I have one question..which is why is there a 15 day delay between Virginia SESA sending it to Philly(09/27) to Philly DOL logging it into their system(10/15).

What with this entire process being time sensitive, this kind of gap/delay is very bad for me as time is crucial...(my H1 time is burning up!!).

Am i reading this wrong?...or is this how it can happen...15 days delay!...what is DOL upto?...


Can anyone elaborate on this?...Any light on the matter will be appreciated.

The time gap of 15 days between SESA approval and file opening with DOL system is nothing unusual. SESA doesn't send the documents to the DOL building the moment an officer approves the case. They take their own time, say 2 to 3 business days to send the file to DOL. Now the officers at DOL wouldn't be waiting there to receive files from SESA. They take their own time to accept the files and then start entering the details into their system. Considering that it a government department, you should be grateful to them that they enter the case in a week. That's when the AVM system will tell that your case is in their system. So do not worry about something you have no control over. Just hope for the best. Good luck.

When to call and what to ask DOL

Hi usnycus,

I have seen your reply. It looks that is the good way to call them. Previously I tried calling Philly DOL and sincerely said I am the employee, they did not tell me any details.

If I pretend as the employer, what I can ask? I have two probable case numbers. So, can I ask them, tell me about all the candidates from my company or like what? ANy ideas?

Secondly, what is the best time to call them? Any day or a particular time or what?

Your reply is greatly appreciated.

Regarding my status: My case went to DOL (according to the automated system and my guess) on October 5th. Till now i did not hear back anything from my employer yet.

DOL number

Hi,
Is there a number where we can 'talk' to someone at Philly DOL. The number I have is (215) 861-5251 but no one picksup the phone at this number. The message I always here is that Kelly is out of office for the week. That's all. Even the main number (215) 861-5250 is only a auto message system, with no real person available on the phone. So, which number you guys are discussing here. Please inform us. Thank you.

I'm in the same boat. I called both nombers at Philly but Kelly is out and main no. is a automated voice message system. When I send an email, it says my info. is not in the file. My file was mailed to DOL on 10/29/02 and I still do not know whether Philly has received my file or not. It's very frustrating!!

That number is only to check the case status using AVM. It's not a line where an officer pickup the phone. Anyway, thanks. Unlike other regional DOL, Philly DOL took care not to give public access to any labor officer.

(215) 861-5251 is the # I used to call before....May be they have changed that # because of so many people calling .....or may be she is really out on vacation.

As u said your case went to Philly DOL on Oct 5, I don't see any reason for you to worry. Philly DOL is still doing a lot of LC applications from Last week of July and First week of Aug. Not only to you but to all the members of this thread, I will suggest not to panic and don't call Philly DOL if your RD is not in Augest or Before. They are approximately taking 90-100 days to process the Application from RD.

Anyway, if/when you call Philly DOL just ask for your case. Tell them that you are the employer and trying to find out what happened to LC Application for employee called "Helper_12".

This is frustrating........

Hi Dependent and Usnycus,
Did you guys heard any news from the DOL or your lawyer. I tried emailing the DOL and it still says that they have received our cases on 8/02/02.

Our company has filled 6 cases and among that 5 are on 8/2 and 1 went on 8/1. and none of them have got certified or the DOL has sent any queries.

I am really worried because I have checked the AVM and I found that my case is still pending and most of the case numbers before and after have been approved.

Please let me know if you have any info or suggestion so that I can talk to my lawyer about it.

I understand the anxiety that some of us are going thru' regarding the status of our applications with Philly DOL. However, in my ( humble ) opinion, let us *not* call philly dol (kelly or whatever number is being circulated here) randomly.

Except ofcourse in dire emergencies. As for those of us, who have their dates far out (mine is sept end-oct), it would be a better idea to get their updates from this forum where people are and continue to update and provide useful information.

That way, we will not lose any access to people that we have by limiting our calls. This person-Kelly or whatever number that we have, will not be able to answer a host of calls if we keep calling and soon we may lose access to one person that we have.

My request to each of us is to, please practice patience anad restraint, let's not make random calls, let's sit tight and help each other with updated information on this forum..

That is a small suggestion that I have. Thanks to all who contributed and continue to contribute!.

Guyz, Please be conservative in making calls to Philly DOL. Please remember always there is a risk in hiding your idenity and identifying you as your attorney.
Please also note that to answer each call an officer needs to take some time out of his regular work, which eventually delay all of our processing times. My attorney was told that these days incoming calls are hiking up.
My case is forwarded from SESA on 10/04 but Phily AVM got my case entree only on 11/04. Please note that there is 25 to 30 days delay before the case is entered into AVM.

Spoke to attorney on Saturday and asked him to check what happened to the LC. He called me today evening and according to him Philly DOL is not responding. He was not able to get in contact with anyone. The Kelly number (my attorney was the one who gave me that #) is no longer working either. I am sending mail every every morning around 5 AM and calling AVM also, still no Luck......Guess they are neither updating AVM nor e-mail related database.

BTW, Last week my attorney spoke to someone at Philly DOL and according to them; at that time they were doing July last week. When pointed out by my lawyer that some of late and mid August cases were also approved, DOL response was "They might be 245(i) or people who are about to loose their status (like 6 year ending for H1-B) or seasonal worker (God know what is that)....

Guy's Plz don't call Philly DOL unless you have RD in Aug or before that. Da_best & Etchoneb are right, this frequent calling will definetly result in delay........I think "NO NEWS IS A GOOD NEWS"........Let's keep our finger crossed......

Philly DOL

Guys,

Try not to call frequently.You know philly director has been changed while ago.My lawyer told me that he is looking at LCs very carefully so please don't do any mistakes.

FYI, I'm running out of my H1B time in few months and mine got approved on Oct 31st whose RD is 08/02/02.

Still, it's not clear why they are NOT evaluating the cases in the order in which they receive.
