Thanks usnycus for your detailed response. I hope you are right and they have not kept our cases aside. And I will definately not make any unnecessary calls to DOL and I will tell the same to all my friends at my company.

I am wondering , how come the DOL will know that the a Particular individual 6 years term is getting expired ? I don't think DOL has any direct link with the INS and I have seen my Labor Petition and in that it has not mentioned anything about my stay in US. Please shed some light if any of you know the answer.

Its freaking me again !!

Yeah... It all sucks, one more time !!.

After a long wait at VA SESA got into DOL with a hope that it will be done soon. Month is gone, two is gone and three is already over and no sign of getting any where.. Frustating.

I have checked so many cases on AVM, there are no updates from last week. Last update is on 11/01. We used to see couple of cases approved every week Wed-Fri. Last week that did not happen either.

Phiily DOL used to be one of the best DOL's.... Not any more.

Folks,
Maybe we can ask Rajiv or anyone knowing any legal expert, if he has any idea of what is happening at Philly DOL and if there is any recourse/action that we can undertake to get a clearer picture out of this.

the least that one can expect is to know what is happening with one's cases... decisions around one's career and family depend on it.

I was also not sure how DOL know's about expiring H1-B so I called my attorney and asked him the same question. According to him the person (i.e. at DOL) with whom he spoke last week was also speculating regarding approved LC from mid or late Aug. But my attorney thinks that sometime employer/attorney do make these kinds of request (.. for emolyee who's H1-B is about to expire). In past DOL used to process these kinds of applications faster. That's was just a guess from my attorney.

Long wait of 18 months is over (Applied in May '01). Spoke to my lawyer and will be doing concurrent filing. It is taking upto two weeks to get the hard copy from Philly. Will update you guys, as I know more.

I have checked some more of 09/08 cases that are approved, along with mine. But there are cases from 08/05 still pending. Don't know, if they are RIR or not.

What's up with usnycus, dependent, needhelp1 (all 08/02)?. Check your status now. There might be good news waiting for you all in AVM. e-mail is not responding, but AVM is.

Nope. Case# is not same. DOL will assign a new case after they receive it from SESA.

All,
e-mail database is not yet updated with Nov13th approvals. I got e-mail after 5-6 hrs and it stii says the old status. So, if any one checking for their case status today, use AVM for latest.

DOL Project to Improve Efficiency in LC Adjudications

On November 4, 2002 the U.S. Department of Labor (DOL) began testing
more efficient ways of processing Applications for Labor Certification
(LC). The LC, which is the first stage of the green card process, is
filed by a U.S. employer sponsoring an employee for prospective full-time
employment, ultimately resulting in permanent resident status for that
employee. The efficiency testing was confirmed by Stephen W. Stefanko,
the Chief Certifying Officer of the U.S. Department of Labor, in a
November 4, 2002 meeting in Philadelphia, attended by Attorney Murthy and
Attorney Finkelstein of The Law Office of Sheela Murthy, P.C., as well as
other members of AILA's Washington D.C. and Philadelphia Chapters.

The DOL testing project is expected to last four months. In
coordination with a private consulting firm, DOL has set up a simulated state
workforce agency (SWA) where a sampling of some 1,530 pending applications
will be processed. As regular readers of the MURTHYBULLETIN and
MurthyDotCom are aware, SWAs (formerly called SESAs) are state workforce
agencies that conduct the preliminary processing of LC adjudication. The
final decision on an LC is made by a regional office of the DOL.

DOL's plan is to explore various processing methods and analyze which
are the most efficient. The ultimate result, presumably, would be
implementation of the best practices system wide. Though the project involves
a simulation, the team will process real cases. Dale M. Ziegler, Chief,
Division of Foreign Labor Certification at DOL has instructed five SWAs
to send a representative sampling of cases: 615 from New York, 300 from
New Jersey, 165 from Maryland, 240 from Texas, and 210 from Virginia.
SWAs will be sending the case files to DOL headquarters through November
to December 2, 2002. The project should not be confused with the
long-awaited PERM program, which is a complete revamping of the entire labor
certification process.

Those whose cases happen to be selected for the testing project will
receive decisions on their applications far ahead of the usual schedule.
Presuming a speedy approval, rather than a denial, this will be an
enormous benefit for that limited group. Of course, many others may be
sorely disappointed to find that a friend or colleague's case is processed
in four months, while theirs remain in seemingly interminable backlogs,
possibly for several years. Since DOL is utilizing the project to
improve efficiency overall, our hope and expectation is that employers and
employees ultimately will benefit.

Thanks for the reply. My lawyer said my application was sent to DOL on sept 18th from SESA, but they didn't receive any case # from Philadelphia. How to find PHIL case #?

I have checked AVM at 1.30 pm 11/16/02 and it is not yet approved. I have sent an email and waiting to hear back from them.

I have asked my lawyer to persue it with DOL why they have not taken up our cases as they have processed cases RD dates ahead of us and I am hoping to hear something from him or DOL.

I will let you guys know if I hear any useful info from my lawyer.

Applied LC on SEP 04, 2001 from PHILADELPHIA. No information
from my Attorney yet. It seems very delayed. Presently, April 2001 cases being processed in Phily.
Here, I have an option to apply from Delaware, now. Does it make sense to re-apply my new Labor from Delaware.
