In addition to the conditions u have mntioned for EB2, more importantly, te job for which you are being sponsored must require a minimum of MS+0 or BS+5yrs of progressive experience. It is NOTsufficient if the alien possesses MS+0/BS+5. The job should require a minimum of MS+0 or BS+5 yrs progessive experience and the alien must possess the minimum qualifications for the job to file 140 under EB2.
Check Item 14 on ETA Form 750 A. If your lawyer filled MS+0 or BS+5 as min. reqts, then u can file I-140 under EB2.

As I am painfully beginning to become aware, your H1-B's LCA (iff your H1-B job description and GC job description is same) also needs to say MS etc...

I got thro here, but looks like my stupid lawyer has screwed me again.
I am gonna have to file under EB3 even though everything was planned for EB2..... new lawyer says we wont be able to respond to RFE iff we get one for this issue.
Also my old lawyer required Masters on LC but only specified 5 years under education requirement.

I am screwed.

I want to know how to check status also, but I think only the people who need to extend their H1B could check, right?

Is there a regional preferance in PBEC.
Most of the cases got approved are from philadelphia area.
And also is it true that by september time frame BEC will publish a time frame chart?
I think CA cases which went to PBEC will suffer the most since most of the cases from CA went to Dallas.

Ok, one more weird case, my friend called me just now to tell me that he got is LC approved. His case detials are:
PD: Oct 13 2004.
RD: Dec 1st 2004
RIR, EB3
He didnt receive his 45 day letter but got his LC approved, it seems from san francisco office.
He is from arizona too and yes the data is correct, 2004.

got answer to this one from the dallas thread. the labor is certified by the SF regional office, so, no 45-day letter..

File two 140s. One under EB2 and one under EB3. Try ur luck. 140 is gettign approved quickly these days. I dont believe they compare H-1B records. GC is for a future job opportunity. Within the same job description, there can be several levels, level I, level 2, level 3, etc. arcgue that the EB2 apllication is for a job with higher seniority.
 
I think I am having a PBEC trauma on my head. Is it true? Somebody with PD 04 got their LC? Man this sucks a big time. DIsgusting. PBEC should go to hell for ruining our life..

That is the most painful part as most employers don't want to wait that long for you to return from vacation. Hope you can find a way to get an interview date before leaving US.

What does "overridden" mean?

I just got a message about my case status from PBEC. They add a new section of Data Review this time, under which there is an "Existence Check" field. Here is the detail.

Does anybody know what "overridden" means? It seems my case closed, am I right?

BPC Progress Report

Hello all,

I hope you are all enjoying your summer.

I am attaching a spreadsheet that has data entry statistics and projections of when partial data entry will be completed and when full data entry of cases will be completed.

I do believe that we will not see a significant number of 45-day letters until partial data entry is completed.

Finally, this is my best guess - if you don't like or agree with my methodology feel free to change it in the spreadsheet, I don't intend to argue about it.

As always, just my guesses based on the information posted on these forums. I have no inside information.
