My friend's employer sold his Business. There some mutual understanding between his employer and new Business Owner about continuation of his Labor Certification which is still pending at PBEC. My friend's employer received and replied 45 days letter last February.

My friend fear that his labor may approved but his 1-140 may be denied.
Please reply what to do now?

GC_Geek,
Triniti,

The way it works in this country is...you have to spend that money on election donations of fat cat politicians.....Then they might pull tricks out of their hats....
But no one can/would promise you three months.....

My question to all forum members....How many of you would donate a modest sum say $100-200 under a group name to say republican national commitee..

The only way to be heard in this country is through the 'zanak' of your dollar coins....

I hope I have understand this right.. If filing for an EB2 then person should have - Bachelore+5 Years Experience+employer should agree to pay the prevailing wage.. right?? Or is there any other conditions for filing for EB2??

Also how can we find out what is the prevailing wage for the locality you are currently working? Any links/information would be helpfull for all so that in case it is applicable for people at least they can suggest to the lawyer to file it in EB2(though the lawyer may not pay heed to what you say)

Thanks

One reason why we can't have any action taken in this group is because we are never able to stick to the core purpose of this forum. This is the same reason active members like Juntha had to start new forum under yahoo so that we can solely focus on BEC and labor.

I can understand any discussion which requires immediate action in circumstances
like layoff or 7th year extension. But EB2-EB3, H1-H4, PERM-RIR discussion is way off-topic and it should strongly be discouraged, particurly when EB2, EB3 has nothing to do with labor certificate. Without labor, EB2 or EB3 is meaningless.

Foreign Nationals

Contributions and donations may not be solicited,15 accepted, or received from, or made directly or indirectly by, foreign nationals who do not have permanent residence in the United States (i.e., those without green cards). This prohibition encompasses all US elections; including federal, state and local elections. 11 CFR 110.20(b).

This is the regulation from Federal EC site.

But I believe that we can donate through other organisations

Any approvals for CA cases

Hi

MY case details

PD on labor - 03/13/03
transfer to - 04/29/04
As per the attorney - transferred to Philly backlog center
EB2 RIR case

Has anyone recieved any approvals for the cases which were filled thru CA ?
Any feedback/relpy is appreciated

Thanks
GCcomesoon

My case was approved earlier this month and I posted the details. My lawyer firmly believes that if there is a pattern to the PBEC, they are now working on those cases which were received in Phili regional, cleared by the SWA. She informs me that she has about 16 approvals from 2002 and 2003, all which had made it to the Phili regional before being transferred to PBECs

In all probablity, PBEC is working based upon on RD received date, not PD or date 45 letter replied.
We have to get the approval pattern from lawyers because they will be getting a lot more approvals than what we are seeing here.

Thanks

So cases from Philly Regional Office are favourites to be processed. This is so unfair. Approvals from 2002/2003/2004 have been reported so far. Whereas many 2001/2002 cases are still sitting there without 45 day letters- Probably still in boxes untouched.

Philly BPC seems to be processing Non-RIR cases that got transferred from Philadelphia.

Mine is from California RIR.

Looks like I'm in the wrong place.

Just a wild guess, do you think that they may get pushed by their PA's senator or congressman to approve those cases?

Optimistic

Guys

1) Most of the cases are RIR ( Probably 80-85% ) so it will take long time to process all of them although it takes very little time to certify. Non-RIR and went to regional ..all of them should be certified in next 2-3 months.
2) Cases which went to regional they will be getting certified first as we seeing it . I sincerely believe that with in 5 months, by DEC 2005, all regional cases ( RIR + Non RIR ) will be ceritified no matter what. PBEC is picking up speed
3) People, who are EB3 ,they should be worried abt PD. In OCTOBER, when it opens we don't, know what will be the cut off date. if u have LC certified but if u can not file 485 then it is not worth.
4) Probably we should lobby for EB2/3 visa increase.

Well.. How can PBEC certify all regional cases first. The Backlog center FAQ on doleta.gov clearly states that all cases will be considered to determine FIFO order and cases will be processed in FIFO order. [There will not be a distinction between Regional & SWA cases]
