Hi all (including Vicky and others from the Philly DOL threads)!

It's great to be in touch with you all again and to have the support that this forum provides!

I added my information to the tracker. My EAD (ND: 10/23/03) was approved yesterday.

I guess it looks like I-140's / I-485's are taking 12+ / 24+ months respectively at VSC at this point? Ouch... :(

But, still, it's great to be here!

Note: I'm using Excel '97. As far as I can tell this shouldn't be a problem but let me know if it is (in which case I'll have to ask others to update my info in the tracker until I can get a newer version).
 
FYI, it looks like the VSC processing dates were updated yesterday at https://egov.immigration.gov/graphics/cris/jsps/Processtimes.jsp?SeviceCenter=Vermont.

For those of you who are in the I-140 (EB3) category (like me), the good news is that the date jumped to 03/22/03 (from 01/15/03). The I-140 (EB2) date jumped to 01/06/03, I think it was at around 05/01/02 previously. Unfortunately I-485 processing times didn't move.

Assuming the pace continues at this rate, this implies the following estimated approval dates currently (for various Notice Dates):

I-140 (EB2) 10/01/03: 11/01/04
I-140 (EB2) 11/01/03: 12/02/04
I-140 (EB2) 12/01/03: 01/01/05
I-140 (EB2) 01/01/04: 02/01/05

I-140 (EB3) 10/01/03: 08/18/04
I-140 (EB3) 11/01/03: 09/18/04
I-140 (EB3) 12/01/03: 10/18/04
I-140 (EB3) 01/01/04: 11/18/04

I-485 10/01/03: 10/07/05
I-485 11/01/03: 11/07/05
I-485 12/01/03: 12/07/05
I-485 01/01/04: 01/07/06

nice projection looks like its gonna take forever to get a GC based on current dates.

but i think we can make USCIS to speed up the process. Mr. Rajiv Khanna has been more than helpful in filing a litigation on behalf of us to speed up this whole process. I would encourage all of you to sign the "Request for your support in I-485 Litigation" so he can represent us as our attorney. Maximum people should sign this as this is the only way out of this pothole. You just have to fill out the basic info about yourself, but you would have to fill out the Alien # or A#. so make sure u have it handy. guys please try to support this as Mr. Khanna has spent lot of time in this litigation and we have to back him up.

If its ok with others, I went ahead and stuck the above-mentioned information into the tracker (at the bottom). As the VSC dates change, we can update the tracker to give the latest estimated approval dates.

If people don't want this information in the tracker, let me know and I'll take it out.

pl advise

My company attorney filed my GC ( I-140 ,I 485,EAD and my wife’s I 485, EAD and AP) at Vermont center concurrently.

MD : 11/30/2003

RD: 12/02/2003 (My attorney say he only received RD only for my I- 140, and for my wife’s I 485, EAD)

Rest other filing(my I- 485,my EAD,and my wif’s AP he has not yet received RD yet. It’s almost now 2 months.

What should I do now? I don’t see him (my companies attorney) taking any action yet. He is just waiting. Can any one suggest what action he should take or there is no option. What I can do in this case? Pl advises me. Thanks

My I 140 show online status that RFE on 28 Th Jan 2004. One week has past my company attorney says he has not received NOA yet. What is NOA? How long it takes to receive NOA. How to figure out what is RFE? Does it going to affect my wife’s EAD? Pl advises

My online status shows
"On February 9, 2004, we mailed a notice requesting additional evidence or information in this case"

Can i call the customer service and find out what info they are asking for ? will they tell me ? or should i wait until my lawyer receives the notice.

I did provide the following documents along with my application:
1) three years' W2's
2) three paystubs
3) Affidavits from colleague(i haven't got them notarized as my attorney said that it may not be necessary) to show experience.
4) my employer's financial statements.

I am just worried what else they are asking for ? Any inputs/ideas from u folks are appreciated.

God, help me out.

ND: 11/18/2003 for all applications.

congrats..was ur approval due to the letters you wrote?? if yes who did u write too?? mine has been pending for over 7 months now..same for EAD

i don't see any reason of not signing it. even i signed it. according to the processing times u shouldn't even hope for ur I485 approval for next 3 years. can u wait so long. plus this litigation is already filed and i think what Rajiv needs is to show to the Dept. of Justice is there are so many people who have backed in this litigation and is approving him as our lawyer. its just kind of support to Mr. Rajiv Khanna that he is representing this many individual who has been affected by slow processing. i think all of us should sign up. there is no harm. plus if u read the whole litigation response that he got, its quite encouraging if Mr. Khanna can convince DOJ and USCIS to consider AC21 from the date of filing of I485 even without I140 approval. won't this be a boon to so many of us. again, i have signed and its up to the individual but i don't see any harm.

2nd Question. It asks for alien number? What is it?

its ok even if its not RK.

Alien # is A#. check ur receipt notice for I140. it should say A#.

not sure about deadline. but RK was suppose to meet someone from DOJ soon.

Help needed...

Hello everybody,
My question is for the year 2002 I have worked only for 6 months and as a result my gross income is significantly less than my 2003 W2.
Will this be a issue as I need to submit my last 2 year W2's for my 140 & 485


Note : I am planning to file my EAD/AP/140 & 485 application next week.


Gurus help me out...

i don't think i ever submitted my W-2's. my lawyer didn't ask for it. do u need to submit W-2's. i think he had just submitted 2 years tax info regarding my company only.

Yes! now a days they are asking for atleast 3 yrs of w2
that was the RFE for me ..
i send my documents to lawyer last week..
So i guess they have found another way to delay the process

if the RFE was only for W-2's then i think i would count myself lucky to have an RFE. atleast that would trigger ur I140 approval. lots of people have been getting their I140 approved in couple of months after an RFE.

Actually w2 info was from my part!..they have also asked about my company's tax and other information..My case is all messed up
as when i joined the company they name was "A" and they split up into "B" "C" and "D" (d being the boss of b & c ) ..Now they merged again to form "E"..i applied my labor in "A" got approved with in "B".. and now it all back to one company with a diffrent name "e"..
Lawyer says she submited the history of the company and how it is merged now!..

more over i was getting paid form "B" some time and "C" sometime..( 2 w2 )..

I am not sure if u understood..but if u cant ..i dont think the BCIS will...
By this time i have a pretty good idea of their smartness :mad:

Have you guys seen the list of approved I-140's at VSC (including a number from 10/03 through 12/03) from this thread (http://www.immigrationportal.com/showthread.php?s=&threadid=113388).

This gives me some hope that things are moving along and that there's a chance of getting earlier approvals than the VSC processing times info would indicate:
