140 RFE

I got a RFE on 140. RFE is for
1)my W2 forms for a company that I worked 5 yrs before. Experience from this is shown as qulification for this job.
2)Also they asked some information about the Affidavit (from a co-employee) that I submitted for my proof of experience for this company. Law Office did not give me the exact info on this but they told me that they can reply to this without no additional info from me.

RFE was issued on 1/23/2004. It was recieved by Law Office yesterday.

That seems to be faster in your case, you applied on 11/25/03
(almost at the end of november) and got an RFE pretty quickly. As far as my friends' experience goes, it shouldnt be a problem your I-140 will get approved pretty quickly, they just asked for additional information.

Did you get your EAD and AP?

I did not apply for AP. EAD is still pending. My case is EB3 category. EAC0403850***.

1)my W2 forms for the past three years..
2) my company's tax info
3) current payslip

RFE was issued on 1/28/2004. It was recieved by Law Office couple of days before..

ND for I140 was Nov 24,2003 -- EB3 info in excel sheet


No news of EAD and AP Yet... :(

Is it a good idea to turn in copies of W2 and pay stubs etc at the time of initial filing? If not, Do all or only some receive this kind of RFE? Anyone know about this? Thanks...

I did send them the 2002 w2 when filing , now they want 2 more years..and in some case they ask 4 years!..so i am not sure..
now i sent them 2001 and 2003 along with that..hope this helps to expedite the process..

Pray to GOD that it will be approved after you reply them as its happening in several cases.

Jack 76, as far as my friends cases are concerned RFE is always good! For all of them the I-140 got approved immediately after responding to RFE. Good luck buddy!

Couple of Questions - & Not 21 questions

I have a question and since I am new to the forum, this question might have been raised earlier in one of the threads.

Curretly on H1B, my company did a concurrent filing on Nov. 7. The lawyers are not willing at this point to file for EAD, probably because I have valid H1B or afraid that I might use AC-21 down the road. Fifth year H1B expires in Dec 2004. I would like to have EAD at my disposal.

The question is, Can I file EAD by myself without the help of the company lawyers?

Any pointers are appreciated.
 
NO!

No Snowbrd! You cannot!

Your lawyer will be having your Labor Cert and also for filing EAD you need a letter from the company with the job description same as your labor cert. There is a link between your I-140. 485, EAD and AP. If you try to do it alone there may be questions like where are the other forms etc.

Again, this is what my lawyer told me.... please contact other lawyers and let us know if any of them give diff answer.

For EAD you don't need any letter from employer, you should just send copy of I-485 receipt. Of cource photos and fee:)
