As far as my knowledge goes, now that you have already replied to an RFE with your W-2s, now BCIS might ask for the pay-slip only at the time you go for your green-card stamping. So I believe now for the time-being if you accept a job with less-pay it shouldnt be a problem.

But yes, there will be an inconsistency in your pay but the probability of that getting affected in your process i less!!

Lets hope that your I-140 gets approved pretty soon, since you had already replied for your RFE, that should solve all the problems you have!!

Yes, the RFE might turn out to be a blessing as many I-140's with at least one RFE have been approved fairly quickly, at least in the past. It also sounds like your current company is doing what they can to support you which is a good sign! The EAD can't be approved unless the I-140 is either approved or isn't approved for 90 days with no pending RFEs but hopefully your company's response is already being processed (and you won't need the EAD until you switch to another company and only if you aren't able or don't want to use the H visa).

I'm not sure myself about how changes to your salary might affect the GC process although my understanding is that there is some flexibility there. Also, the USCIS apparently tends to look more favorably on cases where the employee was terminated vs cases where the employee left the sponsoring company voluntarily.

Hi Guys,
I just came across this thread as my friend told me about the forums. My I-140 and 485 were filed on
OCT 29TH 2003 (Notice Date i think). Still no word of EAD.
I changed my address in mid november as i moved with AR-11 and called NSC phone line and informed them. Does change of address cause a delay. I am desperately looking for an EAD approval. Any thoughts Guys ???

Did you fill a form I765- Application for Employment authorization when applying for I485?

If yes did you (or your lawyer) receive a separate notice for that?
If received look for the receipt number in that notice, and go to USCIS.gov website and you can find the case status there.

Yes i did fill the I-765 form and did get a receipt i have checked the online status still shows the same message that it is taking between 60 and 90 days to process it is already 110 days and no RFE on 140 also it also says 90-485 days. Thanks for your reply.
 
RFE is on Education evaluation and previous employment letter.

RFE date Dec 20th
RFE replied Jan 21st.
I think my case is EB2.

latest VSC processing times

The VSC processing times (https://egov.immigration.gov/graphics/cris/jsps/Processtimes.jsp?SeviceCenter=Vermont) were updated yesterday. In the 14 days since the last update, EAD processing moved up 18 days and I-140 (EB3) moved up 6 days. Unfortunately, I-140 (EB2) and I-485 processing didn't budge.

I-765 (AOS) 10/27/03 (+18 days)
I-140 (EB2 excep. ability) 01/06/03 (0 days)
I-140 (EB3 skilled worker) 03/28/03 (+6 days)
I-485 01/31/02 (0 days)

Urgent help on AP/H1B

Hello Friends I need your urgent help in understanding AP and H1B issues:

I am on H1B with I140/I485 Pending at VSC. My current H1B has already expired but H1B extension is pending with VSC as I have 2 more years for H1B status. Now I have to travel outside USA in July 2004 and I am thinking for applying AP as well but hesitate because don’t know the answer to following questions

1. If I file my AP application and my H1B extension get approved before AP approval, then Can I go out and get H1B stamped and come back on H1B. Will there be any problem for I-485/I-140 as I will be leaving USA while AP is still pending. Will I have to wait till AP application decision made?
2. If AP application and H1B both are approved and I travel outside USA and use AP for reentry (as I want to avoid H1B stamping in that case), Will I loose my H1B status? What if my I-140 denied while I entered on AP? Will I be able to continue in valid status H1B as I will have H1B visa valid till 2006 or I have to lease USA and apply for a fresh H1B.

Gurus please help me as I want to file my AP this week.

Call the NCS and enquire about your case. If you need a EAD you can walk into any nearby Service Ceb=nters and ask for an Interim EAD which would be valid for 3 -9 months.

My EAD finaly approved today 02/23/04. It says new card will be sent soon.
