I don't want to spoil the optimism here.

I just wonder how often NY DOL and Federal DOL deny a application, or put it in another way, what is the chance of an application will clear at both level.

also, given regular labor cert. is MARCH 2001, How bad it could be if the RIR got denied.

one more question, which level (ny dol or federal dol regional office) issue the approval, since the automatic phone in NY DOL said: the employer or attoney should hear from NY DOL within one month of processing.

Thanks in advance for info.

Actually the denial rate is somewhere in th 10%~ range although this is artificial because they tell you they are about to deny so you withdraw your application.

Regional issues the approval, which number are calling?

the number is 212 621 9330

10% is risky, it is 10% for RIR ONLY?

when you say "withdraw", are you saying that you withdraw from RIR and line up with regualr LC with your RIR priority date?

thanks you

Yes, 10% for RIR...

You can withdraw instead of getting a denial, I guess in theory you would do this so you wouldn't have a denial on your record and you wouldn't have to wait 6 months (not sure if it is 6 months or 1 year) to reapply.

About the phone number, I actuall don't know if they notify employer/lawyer, definitely not us, that the case beeen transfered to regional or if you only hear about your case once it has been approved by DOL regional.

yesterday I spoke to my company lawyer and till now they didnt get any approved labers of June 2001. They applied 4 labers in June 2001. I will let u know if they get anything soon..

Regional status

ny-quant and nydeal -

Can you call 212-337-2193, enter the company phone number that was used on your ETA form, see if you get status on your case.

You may need to "scroll" through multiple cases.

Let us know.

After reporting from the LC database I downloaded from http://www.flcdatacenter.com/casesearchperm.asp,
I found that the denial rate varies by occupation and it was less than 3-4 % for software engineer, for the given data, since 1996, for NY state. I have not yet seperated RIR from it, so this is total.

Don't forget that you were looking at only the regional denials for applications having approved by SWA.

The SWA level of denial would be much larger, but more difficult to estimate -- these denied by SWA would not appear in this table at all! Only whatever approved by SWA and coming to the regional appears in the FLC (federal!) list.

Alas... The http://workforcesecurity.doleta.gov/foreign/contacts.asp site has this information:

Foreign Labor Contact Information

Please be advised that the NY Regional e-mail and Telephone Information Retreival Systems will be down until February 28.

Regional Office Telephone Information Retrieval Systems:

Boston 617-788-0171 Dallas 214-767-9384
New York 212-337-2193 Kansas City 816-426-3880
Philadelphia 215-861-5250 Denver 303-844-1674
Atlanta 404-562-2131 San Francisco 415-975-4617
Chicago 312-353-1059 Seattle 415-975-4617

So even if the phone works -- the information is obsolete like in the web form mentioned in this forum before. The lcstatus02@doleta.gov does not work either yet... Will try after 02/28... sigh...

we are all waiting for a word form ARAINA77, YAMITO. those two only submitted their labers in June 2001 as per our ny laber.xls.

ARAINA77 and YAMITO we are just waiting for your response
please let us know did you got any info from your attorneys??

now NY DOL are doing June 2001 cases

Issues with Virtual Office

Issues with Virtual Office
Did anyone get any NOF/Remand/Rejection based on their company office location etc. apparently lots of employers are getting NOF for filing in states other than their own.

Follow this philly DOL thread below to learn more:

also see this:

What exactly did you want us to check in that bulletin assur ?
A true example
An employer files LC for "A - sw engr." in faster state
Same employer files LC for "B -sw engr." in slower state
"A" gets GC faster than "B" (gap of 2 yr)
Imagine it. There should be some check and balance to otherwise employee suffers while employer does not care.
