guys,

Dont stop... sending mails to DOL. This is the way they will rise from their burrows and do the work.

you can even send junk and redirect all the city garbage to DOL office and even to their homes.......

I think the labor dept question is very clear: who do we represent ?//, and we represent our self as Foreigner workers who are requesting to speed up the process of LCA

why are you so discouraged and depressed man...have patience man..dont think otherwise..here all are waiting for labor approval...everyone filed in 2001 and expecting their labor to come..so please post good and kind words man so that all feel some comfortable at this juncture..we need everyone support man...

Represent the hundreds of thousands of RIR Labor Card applicants in New York State. If they want, we can get all the sigatures, and sign a petition.

sankat_mochan - The letter will very likely lead recipients to this website. I know we are all frustrated but nothing is going to come out of negative comments.

nomorewait - I know you were trying to make a point but there are about 60,00 labor cert applicants in New York.

Hey guys,

I have already replied. Here is what I have written.

We are representing all the legal professional
immigrants who are suffering because of the illegal
immigrants(245i).

We have been waiting for 2.5 yrs. now and still have
to wait 1 more year to get our labor certification
from NY DOL.
 
Guys,

The right to work is something we don't have without authorization:

The law protects jobs for US citizens.

1) I think the primary function of NY SESA is to protect US citizens from losing job(in some case to us (h1bs). So in that sense, it is not doing any damage to US citizens. Most Americans think foreigners steal their job. So they won't care if we wait for more than six years or so. Since we don't have right to vote, nobody will care about our sufferings. So sending our stories to the media or the department won't make much difference.

2) We should not take Labor Certification approval for granted. As they can lead to denial also. Since you have to prove that there is not US labor available. And in such an economic enviroment it takes more then just some paperworks prepared by lawers.

On hte other hand, the law ensure there is justis to every human being, and there are something we can do

1) I believe the delinquent job done by NY SESA, has cause damage to lots of us. I believe many of us may suffer from psychological problems like depression caused by this. One thing we can do is try to seek justis to the damages throught court. Brought up some lawsuits against them. Although I don't know if we can really got some thing for the damage done to us, at least it will show them that at least we have some civil right as human beings.

2) Since media won't be interested in us, we can start some non-violent demostration in the NY SESA locations; start web sites, and let people know how the NY SESA's delinquent job has been;

We all love this country and its people, otherwise we won't be here today. I would not say that we are slaves, since we can leave this country anytime, but we definitely don't deserve all these suffering as human-beings.:cool: :cool: :cool: :cool:
 
The idea of the campaign is to speed up the process of labor certification by NY SESA, so shouldn't we wait and see the result of what we still doing before going into the lawsuit and demonstration things.

did any body got response from the senators / labor dept or the media ?
 
class action suit

I think the idea of a class action suit may not be that far fetched, it may be possible to base it on ethnic discrimination or something like that.
Does anyone have any thoughts on what sort of attorneys would be into something like this? I guess the trick here is that we're not really looking for a large cash settlement, just for the NY DOL to do its job, so this isn't anything for ambulance chasers looking for a commission.

i just browsing to other state threads also..it seems maryland came out of this april 2001 stuff and now they are doing sept 2001 RIR stuff..
i dont know when our NY will come out of this big mountain and start our process so that we can get our labor cleared and got next stage 140/485...:confused: :confused:

Department of Labor Update – October 2003


PERM

The DOL still expects to publish the final PERM regulation by the end of 2003. The DOL stated that they will implement PERM 120 days after the required publication in the Federal Register. (Previously, they had stated that the period between publication and implementation would be 60 days).

Before the PERM regulation may be published as a final rule in the Federal Register, the DOL must forward the rule to the Office of Management and Budget (OMB) for their comments. As of the time of this writing, the PERM regulation has not been forwarded to the OMB. The OMB has no set time in which to comment on most rules, so there is no guarantee that the OMB will approve the final rule for publication according to the timeline that the DOL is contemplating.

RIR Processing

The DOL headquarters is expected to issue field guidance on Reduction in Recruitment (RIR) processing by mid-November 2003. This guidance is expected to provide insight on adjudication of RIR applications that have been pending for lengthy periods, as well as how the DOL will consider new applications filed under RIR procedures.

Backlog Reduction Plan

Two backlog reduction centers are scheduled to open in Dallas, Texas and Philadelphia, Pennsylvania. The pilot backlog reduction center in Gaithersburg, Maryland, however, will be closed at the end of 2003. The two new centers are expected to become operational quickly, resulting from the testing of software and the development of training materials at the pilot office.

The various avenues outlined above are steps in the direction towards reducing labor certification backlogs; which, obviously, are desperately needed. With the implementation of the field guidance on RIR and the publication of the PERM regulations, we anticipate that years of waiting for labor certification approval will be a thing of the past. Hopefully, PERM will not make things worse in the future, with LC cases being quickly approved, only to be revoked upon DOL investigation. If this is the resulting situation, we will have solved the problem of delays with the bigger problem of uncertainty when an LC case is finally approved.

I hate this kind of news , NY has the worst backlog and does not have reduction center:
