New York City Transfers

Guys,

Hope everybody in this forum doing fine. Any good news on interview letters from NYC. Mine is waiting for interview letters. Passed 17 months after transfer. Case is EB1 and filed in June 2002, XFER in May 2004, and applied EAD/AP for 4 consequtive time.

Appreciate your guys inputs.

No Updates on processing dates ..yet?

Hello all,

Hope and pray that you all are keeping cool. I can imagine the pain.. I have endured the worst ... So, I sincerely pray that no one should go through this waiting game. May Allah s.w.t. help us all. Amen.

Any idea why there is no updates on processing dates..

Think about me..

NYC is processing (as per the record) December 16,2002 cases ..mine 1/3/2003 !!!

PD is 1/1/1998 and mine is 1/23/1998 !

I am stuck for little more while ... was not I so close to freedom ?
 
Want to change employer

Hello Guys,

Lot of us have been waiting for Interview and 485 Approval, I was wondering if any has changd employer. Here is my position, PD 02/14/02, 485 pending since 12/28/04, xfered to NYC 8/10/05. Got I-140 approved in Sept'05.

I am seriously thinking to change employer, what's your experience, what are the issues with AP/EAD renewal etc.

I suggest if you are serious changing the employer go ahead and do it, it is fine to do it since I have friends who got thorugh their interview smooth although they had changed their jobs six months ago. even myslef have changed the job from my original filing sponsor to other.

You should go ahead and change employers but make sure an attorney files the required paperwork. As long as you are in a similar occupation you should have no issues with the case or renewals of EAD/AP.
 
Can anyone tell me what time frame the NYC office is processing now for I-485 transfers?

The date has been stuck on Dec 2002 for months and months now. :(
Is that accurate?

I guess they are not processing anything rightnow, the date is on a still for a long time cause they will not be scheduling any further interviews due to retrogression.

I think if you guys falls below cut off date, you should be fine. You will get interview letters shortly.

Interview on Oct 24, 2005

I, my wife and son were interviewed on Oct 24th,2005.
Appointment time: 10:30 am for all
Arrived at about 9:00 am
Went to Floor 8-Rm 800- window 54 -showed the appointment letters.
The lady gave a form to each one of us for signature and index finger-print (on both sides of form).
Waited for interview until about 10:45 am
The officer took us to her cabin, asked to take oath.
Asked for employment letter, tax returns and paystubs.
Affidavit of support for spouse and son (with supporting documents i.e. employment letter, tax returns, paystubs)
Submitted medical for my son (earlier was done in 2002, so we did it again; for me and my wife we had submitted in 2004, in response to RFE).

On her computer checked status for each one of us.

My case was approved and passport stamped.
She said FP check for spouse AND background check for son - not yet complete. It will take for approval about 30 days for my wife's case and up to 90 days for my son's case. She wrote on their passport - I-485 pending alongwith the interview date, etc.

Overall, the lady was a thorough professional and certainly knew her stuff. I am happy that at least my case was approved (I am the primary applicant) and I hope my dependent's will be approved soon.
I would appreciate if someone with experience can comment on the following.

1. Generally, how long for the plastic card?
2. Does the status on-line get updated?
3. Any experience of the actual time after I-485 pending stamp? Do they send approval letter or directly the card?

A1: Probably there is no such a thing as "generally". I saw some people here received welcome letter in 2 weeks and the card in 4 weeks after local interview. I also saw some people here waiting over 6 months and still got nothing. So, I don't think there is a rule here, which is true for pretty much everything happened within the USCIS.

A2: No, as far as I know. According to people who received the card, the regional center will assign a new case number when they receive the approved 485 from local office. Therefore, there is no use to check online status using the old number. And I don't know if it is possible to find out this new number before the card arrives.

A3: Don't quite understand the question. Isn't it the same as Q1?

Anyway, my case is very similar to yours: Mine was approved, but wife's is pending for "background check". They didn't tell me how long it would take, though. So, it's good to know from you about some new information.

I pulled this info from the adjudicator's manual. A link is available from the front page of this website. From what i understand interviews should continue regardless of visa unavailability. Do you understand it the same way?

(e) Retrogression of visa numbers. Generally, the availability dates on the Visa Bulletin move forward, but they do not move forward at a consistent pace, and they sometimes retrogress (move backwards). If a visa number retrogresses after an alien has properly filed an application for adjustment of status, and the alien appears to be eligible for such adjustment, he or she is allowed to remain in the United States until a visa number again becomes available. However, if the alien is not eligible for adjustment due to an issue not related to visa availability (e.g, inadmissibility under section 212(a) of the Act) the application should be denied accordingly. Therefore, the adjudication (including the interview) should proceed regardless of the visa availability issue and the application held in abeyance pending a visa number again becoming available only if the application is otherwise approvable. While the case is awaiting availability of the retrogressed visa number, the alien is eligible for issuance of advance parole for the purposes of travel outside the United States and return, at the discretion of the director having jurisdiction over the matter (see AFM chapter 54).

the processing date at NYC district ofifce is stuck on December 16,2002 still ?

I know, in the past this processing date did not mean anything as they were precessing cases at random. But if there was any truth in this type of date declaration, then according to the manual it should move regardless. Right?

I am very close to freedom (though still elusive !) by any measure that they consider in processing ...

RD 1/3/2003.. they are processing December 16, 2002
PD 1/22/1998 ...Visa cutoff date 1/1/1998 !!!!

Thanks for the info, Although it sounds very pleasing but regardless of what they mention in the manual, I don't think they have read the manual themselves. These cases are processed randomly for sure and now another excuse for them to sit on their fat ass is the retrogression, they will not process any cases without current priority dates and the rest of the cases are sitting in what they call is " abeyance".

I don't doubt the power of my great GOD up there, if HE wants HE can get all of us out of this mess, But HE has to test them too, so hey I guess HE is the one to decide now...
