Nebrasaka I-140 Excel Scanner ..

LOTS OF RFE's .. not good

Today's scan results are surprising, lots of RFE's for cases aroung 8/11 - 8/18 ,, don't know why they wanted to do all the RFE's in one day ????

Please correct me if this is right.

"Currently, 140 cases with CP are being processed."

Please explain this disparity.

My 140 has ND of 08/27/03.I see cases with ND later than mine are getting approved. However, my case is not seen at all.

INS treats cases like a pack of cards. You can pick any one at random.
There were cases in NSC of 10/03 which were approved in 2 months while there are still some cases that are pending since 07/03.
Your file may go to a lenient officer who approves cases immediately if you are lucky.
Or your file may go to an idiot whose only job is to send RFE's or delay cases if you are unlucky. It appears todays cases went to such a moron.
There is very little rational in INS way of working. If you see the tracker sheet it is full of such disparities.

karapra, can you post your excel with all the case # for date 9/4 and 9/5 .. we can consolidate into one excel later and it can be used by others too..

Rename the excel to something like sept_4_and_5.xls , so that everyone knows what date's cases the excel file will have..

I guess your case is a Labor Substitution. Am I Correct?? You should hear something before end of Next Week.

Guys.

First off, this is a great thread. Kudos.

I am sure this question does not belong here. However I will try my luck. What is labor substitution? Where can I read more about it? I wanted to check if my 140 falls under this category.

labor substitution is when one files I-140 and I-485 using someone else labor.. like when an employee in a company files a labor and it gets approved but he leaves the company, the employer can use this same labor to file I-140 and I-485 for a new employee... This new employee need not have to file the labor again and he can bypass the hassles of labor certification..

The real problem will be to match everything on the labor which was approved.. the qualification, experience and skills should match the labor for the new employee who will use this certified labor certification..

I hope I answered correctly, if not anyone else can correct me.
 
More RFE's

This is too much.. today also I see more RFE's !! not good.. This is the first time I am seeing two consecutive days where RFE's are being sent upto 80% cases..

I think those officers who came back from H1 job do not know how to certify I-140 properly with the given info and are just sending RFE's without even looking at the cases..
