Could you tell me the forum info.?

I'm not sure whether or not it is true.
But, MDGC in our forum, got 'Notice Of Finding".

MDGC, could you explain to RahulatDC in detail?
 
Notice of Finding details

MD SWA sent a Notice of Finding that the wage in the labor certiifcation application is short by $9000 from the prevailing wage.

I had two options.

a) Increase the wage in application by $9,000. Re-advertise job internally within the organization for 10 days and submit results of advertisement to SWA. SWA may come back and ask advt to be released in public media. Then I will be back to square one.

b) Submit a rebuttal with wage surveys and insist that the original wage is fine. SWA may or may not agree with the rebuttal.

There was much "see-sawing" and finally went with option a) and submitted reply.

Then, no news till date!!!!!!!!

Weired!!

I looked at 'Phily DOL' thread.
I could see VA and Phily guys.
But, I could not see MD guys.

Why?

Are MD guys lazy?
If not, Is MD SWA not working?

It's not that MD guys are lazy, they are simpley frustrated by the processing speed. There would be people talking if there is any movement in processing. Since Damn thing is sitting at April cases for ever.
There is no exitement, hopefulness for talk. People are hopeless and sad and scared in this rough economic time, hope for greencard is becoming just wishes..
But I think all is not lost here..April(RIR) probably will be finished in next 4 months. Probabl after that we will see more hopefuls writing on this board :D :D
 
My point was that MD SWA has processing 04/30/2001 for last 2 months.(started around 03/07/2003.)
It means that some of us should have any form of notification from the MD SWA whether or not it is approved.
But, I couldn't see anything.:confused:

Oh man, first that long wait and then this, It seems like we (legal immigrants) paying the cost of 911, terrorism, down economy, well I'll wish and pray, you'll get some option and labor cleared soon
 
Hi guys, I just registered.. I have been reading the replies for a while and I have this question. Why does everyone concentrate on April? Is april the only month that is heavily loaded? What about May, June, July? Mine is in July and if it goes with this speed, I think it will take about 10 years just for labor cert.

Do you think May and the rest will be faster? and Why is April so over loaded? You guys seem to know more about what is going on. thanks for all the valuable information.

Labor delays

My 6 years on H1 is expiring on July 31st. Its been 2 years since my company applied for my labor in Maryland, which is still in the State DOL. But now I am going be laid off in October. My Question is :

1. Can I go on H4. My husband is on H1 and his labor is pending for Over a year?

2. can I switch to another company, since my current company has applied for an extension of H1??

3. Any other options??

Please advise.
 
I got NOF(Notice Of Filing). MD SWA is requiring "a new 10-day posting with our company's new address".
The posting should be up for at least 10 business days in a conspicuous location at the work site where the alien is employed.

I now don't understand what exactly it means.
I now am contacting my lawyer.
I'll update if I get anything.

Does anyone received NOF?
If yes, what happened next?

I should look up this thread, but I'm very nervous now.

I wish mine is the last application of the 04/30/2001.

The NOF is for internal(at the company's wall) posting only.
My lawyer does not expect public ad after NOF.

I forgot you got NOF.

I think you are in better shape even though you have recived NOF, since its only internal ad they are looking for.

Yes, It is better.:)

The post will be dismissed 05/16/2003.
My lawyer said it may take few weeks after that
to move forward to Phily DOL.

I'll post if I get anything.

We haven't decided which way to go. I'll keep u'll updated.

If any of you have encountered this before please advice on your course of action.
 
What I mean is that when they(not, you) received your application.
I also received the receipt around Oct 2001.
It said that they received my application at 04/30/2001.

Based on your info, your receipt date is supposed to be 04/30/2001.

Looking at the recipt date from people on the list

Notice the time of recipt notice between VPR, HMD, and WKG. The time difference between VPR and HMD is 3.5 months. And the recipt notice between HMD and WKG is one day, they applied 4 days apart.

By doing unscientific analysis I expect april'01 to finish in 3.5 months and then after that every 4 days will be processed in 1 day.

I feel sorry for HMD, he is like last application on the april 30
