marry a US citizen after winning DV lottery

I won DV 05. I expect my number will be current around June next year.

My boyfriend and I did not plan on getting married whn I won the DV, however we have since decided that we are ready. My boyfriend is American. We have been living together since before I applied for DV and have lease agreements, photos and such to prove this.

I don't know how this will impact on everything. The way I see it we have a few options

1. Go through with the DV. Would he be able to attend the interview with me if we did marry? Would they question why we are going through DV process instead of spousal visa?

2. Forget the DV and apply for a fiancee visa (we would really rather get married in the United States rather than Australia). However the fiancee visa is technically a non-immigrant visa, so I'm not sure whether I could be given a fiancee visa after having filed DV papers.
I guess if it comes down to it, we could marry here in Australia and apply for a spousal visa, but I'm not sure if I can have the spousal petition and DV petition going at the same time.

I know this is a pretty unique situation. Buuuut....Anyone have any info? I guess I really should be asking a lawyer this just though I'd ask around.

Intent to marry a US citizen is certainly immigrant intent. However, the K visa is only for the purpose of entering the US to marry a citizen. Since you're already here, just get married, file the I-130/485 and be done with it.

Don't waste your time with the DV process.
 
hmmm, I wouldn't be so quick to abandon the DV lottery process. I know a few people who have had conditional GCs or were on the process of adjusting their status, when they applied for and won the lottery. They successfully went through the DV process and got their unconditional green cards.

Since you never know what is going to happen to your marriage in the meanwhile... Have you heard of the spouses of the U.S. citizens getting deported after their U.S. citizen spouses died (while in AOS mode)? Have you heard of spouses not getting their GCs because marriage fell apart while in AOS mode or conditional gc stage? I have. :(
 
I hust recently won the DV 2012 lottery, I will be marrying my fiance who happens to be a US citizen (this is a genuine union, not those scam marriages I keep hearing about)

I was told I could apply for an unconditional GC through the DV process, get married and after 3 years of marriage apply for citizenship.

Could a knowledgeable poster please confirm whether or not this information is correct.

Correct.
You could also first get married, then apply for an unconditional GC through the DV process, after about 3 years of marriage apply for citizenship
 
Too bad you are using a GC from the lottery whole you don't need it, someone else who is not marrying a citizen could use it better since you already have an advanced chance for a greencard..to me this is shelfish...JMO. Sorry, just being honest.

How am I being selfish? please explain because I don't seem to understand where this is coming from, I'm new to this so maybe that's why...

I am a first time applicant and was fortunate enough to be picked for further selection for the DV 2012.

My relationship with my significant other is genuine and I honestly look down on anyone who degrades the sanctity of marriage by involving themselves in scam marriages. I would have married her with or without US citizenship and she would have done the same for me.

I think it is working out for the best that I get the GC on my own that way we can kill any doubt on her families (well the extended family) side.

Opting for a 10 year unconditional GC as opposed to a 2 year conditional one is a no brainer. I will not pass up an oppurtunity like that.

My Question to everyone else is:

If you won the lottery and were about to marry a US citizen.... what would you do?

Well, interesting question. I hope what you're asking is "which way is it the best for me to try to pursue a legal status in the USA, through a genuine marriage to my USC fiance or through the DV-lottery selection?"

If that is the question, then I (being in your shoes) would go for the DV lottery application.
Here is why.

Being selected in the DV lottery is something one can never plan or fake, while the marriage is (I am not suggesting that you do or anything like that, please do not get me wrong).

Yet if one goes for the AOS based on the marriage to the USC, one puts him/herself and the spouse under the unpleasant scrutiny from the USCIS for the duration of the conditions of the LPR status.

The spouses would have to be proof of the bona fide marriage. There's questioning during the GC interview, there are limitations of the conditional LPR status, there might be unannounced visits of immigration officials to the place of residence etc.
So if I were you I'd definitely go my own way since the requirements for the DV visa or AOS are pretty low.

Besides there are more reasons, but they are not related to the immigration status...

What i shoud to do if i submit my 260 application delay . I did that in 30/5 2021and my case 2021as28xxx
