I am still waiting. It has been more than 6 months. Today USCIS reached the processing dates to april 11th but I have not heard anything for my case. Can anyone tell what should I do? Any help will be appreciated.

thanks man,
i still have not recieved any update yet, Fedex shows they recieved on 10/10. the only explainantion i can come with is that possibly case is transfered to Texas. getting little frustrating.

Guys,

Can anybody explain me how this 485 thing works, i mean i saw people who got 2006 pd also applied for concurrent filing, mine is march 2005 pd, but my lawyer says i cant apply for 485 until 2 years from now. Why like that? Is this because am from India?

You do not seem to be aware of the current retrogression of dates for indian and chinese nationals in particular. Even if you are EB2, as an Indian citizen, you are only able to file a I-485 if your Labor was filed prior or on JAN'03. So your lawyer is right, you must wait.

Mine is similar to yours and haven't received the I-140 approval yet. There has been no RFE yet. Is that good for quicker processing?

I-140: FD:5/23/06, LUD 7/29, AD ?
I-485: FD 07/06. FP(code 3) 7/25, LUD 7/26

Is your case EB2 or EB3. I have noticed that EB2 cases are moving faster than EB3 for some reason. I think not getting too many LUDs on your case is also good. You seem to be in the same bucket as my case was. I only got one LUD on 7/29 like yours before approval. You should expect approval real soon if you are EB2 in my mind.

RFE:A2p & prove BS+5.
submit audited Tax return. B.E.(India)+7 years Progressive Exp.submit all exp letter with employment date,title & job duties. some exp letters was old and some new with current issue date.
 
What is LUD and How do you see it?

Guys,
What is LUD? How are you seeing this status? When I check my 140 status in USCIS online center, I dont see anything like this. All it says is that my 140 was received on June 5 2006 and it is under processing. Is there any other place where you can see more information about the application?

My case is EB2; LCA approved April 06 and 140/485 filed concurrently on June 5 2006.

In order to carry your PD to the new company that you would join, you need to have I-140 approved. You may wait till early Nov. before converting to PP but with the speed that NSC is processing, I doubt waiting will help. My suggestion in your situation would be to not wait, apply for PP and get the I-140 asap.

May I ask why upgrade to PP and pay $1000 if visa not available yet?
I have been asked this question by my lawyer when I request the PP upgrade for my 8/14 I-140. In other word, what is the benifit of I-140 fast approval without I-485?

PP upgrade may help those whose current h1 is expiring soon and need to file for an extension and an approved I-140 can be used for a 3-year extension instead of the regular one year.
