No, I'm just saying that I've seen I-485 approvals like a month to 3 months after having the I-140 approved. I saw them at murthy.com forums.

This by no means means that I-485 are being processed in that timeframe. They may have been isolated cases. Also, in concurrent filing your I-485 is getting processed in parallel while you are doing the I-140, for example you can get your fingerprinting done BEFORE the I-140 gets approved or touched.

The only thing we know is that if you file an I-485 it will take max 11 months, and probably less than that.

ok then this makes sense to me now.but comparing TSC to NSC, there is around 3 months of processing time difference. TSC is much faster than NSC. so the lucky guys will get their cases handled by TSC otherwise wait in the uselss NSC.

I don't know what this means but my assesment is that they are approving cases based not only on LC priority date, but also based on visa number availability. My case is older than johndoe's but my I140 approval would mean nothing unless numbers for India become current for EB2....

Well, if your theory holds true I could hear about my case in a few days. Its an EB2 non retrogressed LIN-06-177-xxxxx . I'll keep you posted

does anyone knows how one's file stays in NSC or get transfered to TSC? is it by state filling or what? I wana file soon councrently and i will be very glad that my files go to TSC, is there a way to synchronize this?

Apparently, Half of the cases one day go to NSC, the other half go to TSC. Also, if you file electronically your case goes to TSC. So if you file electronically your case would go to TSC.

However, the fact that TSC has been super fast in the last few months does not mean it will continue being so, specially after the introduction of premium processing of I-140s. But looking at the backlog of cases it still looks worthwhile to try to send your case to TSC.

but if u file electronically, u just file i think i140 right? there is no i485 electronically yet. so if i wana apply concurently how i will do that?

Your assesment is correct. If you want to do concurrent filing, which is probably something you want to do, the USCIS will pick the processing center for you. There is nothing you can do about it.

Have you thought of I-140 with consular processing? Thay may turn out to be faster for you, but you kind of miss the protection that filing an I-485 gives you.

the second scenario that i can do is to apply for i 140 electronically alone. then i apply to i 485 by paper in few weeks afterthen . as i understand if ur i 140 is in texas then ur i485 will end up also on texas. i'm right?

I am unsure if the USCIS would actually pair up your case with your I-140, you would think they would do something like that, but who knows. I'm also unsure you can file an I-485 all by itself without having an I-140 approved. Check with your lawyer first.

I think you are correct in that you need to file your I-485 at the service center processing your I-140 application. You do not need to wait for your I-140 to be approved to file I-485. You can wait until you get the receipt notice for I-140 and then add a copy of that to the supporting documentation for I-485.

According to my lawyer, this is a better strategy anyway as it helps the USCIS 'keep the two cases together'. I did this and I got the finger print
appointment shortly after the I-485 filing.

The NATSA sent a letter to the USCIS asking a bunch of questions about their procedures. the USCIS replied the letter, question 18 is about the NSC/TSC split. I have no idea if this still holds true but its the only reliable information I've seen about this matter.

18. How will cases be divided between NSC and TSC? Will cases be transferred from NSC to TSC? How will they be transferred? Will the receipt notice tell us which Service Center has our application?
One-half of each day’s incoming cases are shipped to the TSC through a courier service. Cases are shipped prior to data entry so you will get a receipt notice indicating which center has receipted, and will work, the case. FYI, all electronic filings are being routed to the TSC.
 
I- 140 in EB2 approved from Nebraska CIS

I-140 Filed on Apr 11th 2006 (EB2 && PD: May 10 2005)
Got RFE on July 31st.
Answered RFE on Aug 22nd and approved on AUg 29th

THis I-140 was filed as Future employment and the labor was approved in PERM

I received this Email message from USCIS:

'On August 28, 2006, we received your response to our request for evidence or information. However because preliminary processing was complete, the remaining processing time will be less than the maximum stated in this message. You will receive a written decision on this case. You can use our processing dates to estimate when this case will be done. Follow the the link below for current processing dates'

and my LUD becomes 28 Aug
next day LUD changes to 29 Aug.
No changes today

Can u pls tell how many time ur LUD changes?and pls share the dates and also what was the RFE about?

My I-140 went NSC whereas my I-1485 was sent to TSC after we attached the Receipt notice. I-140 was applied in May and I-1485 in July.
Not sure if the fact that both went to different centers will impact the processing time. I received my EADs and APs. Will I-485 be impacted as I-140 was filed in another center?

A coworker of mine sent his I-140 in mid august, it ended on TSC and got approved in 15 days. Mine who ended in NSC is still pending after 4 months. Seems that TSC still going really fast.

RU SURE UR I 140 WENT TO NSC AND I 485 TO TSC? HOW DID U CHECK THAT?
 
New LUDs, approval or RFE coming??

I just checked and I saw that I got LUDs today in my I-140, I-485 and my approved EAD. Not in my appoved AP. Haven't got any emails regarding RFEs nor approvals and status has not changed. I'll keep you informed, see my signature for my details.

Is this a system wide LUD touching? Or these are actually mine...

why time did you get your emails? did you see LUD changes before getting the emails?
