yeah it makes sense for you to go premium , if you get approved in a weeks or so , i am sure you will have green card by dec or jan.

i don't have your details, can you please tell me ur filling details as well as country of birth.
if you see Bartolo5 is EB-2 NON-retro. which means his PD is current and visas are available. i have also noticed that if your case is not very complicated then you stand more chances of getting approved through premium.

ofcourse most of it depends on your circumstances but if it was me, even if PD is not current i will just pay $1000 to have application decided in 15 days . i think its worth for peace of mind.

if i were you i will definitely go for premium, your file has not been touched since 7/22. mine was also touched on 7/22 but then i applied on 4/26 and got RFE on 8/16.
recently Vermont center has send lots of 1-140 files to Nebraska which had lead to delay in processing, i think your regular file should be decided in couple of months but then u have visa availbale so why not get GC ealier than usual.

if $1000 is not that big of deal for you then go ahead for premium.

So this would apply in my case as well. My file has not been touched since 7/29 and my RD is 5/22, and I am non-retro EB2 as well. But I am sure my company would not go premium since getting I-140 isnt blocking anything for me, so I guess I will just wait through a delay of a couple of months worst case.
 
My Lawyer mailed I-140 Premium on Sept 15, and I haven't hear anything back from him, can anyone tell how long it take to get the Receipt #

i guess we should put that in this way. if you are EB-2 non-retro ,and have applied in may or later and didn't recieve RFE. then yes premium is good for you. i have also read on law firm sites that soon EB-2 non-retro will also get retrogressed due to early approvals of LC from Perm process. also now all 1-140 are being decided in Nebraska which is mostly likely to add delay . before all 4 centers were processing.

above all it takes u one step close to GC. you can tell your company lawyer that you will pay $1000, i don't think that should be probelm.

Well retrogression of non-retro Eb2 is big rumuor at this time of year as oct has just started............I don't trust that.

As my previous employer(original labor) wants me to join him again,and priority date is current with my original labor.
So now can I go for premium processing with original labor.

What happened to NSC's claim that they will be improve their 140 processing 'dramatically' soon? I hope our April folks get cleared soon. Good luck to all!

I don't think you can apply for a new I-140 if there is another one pending like its your case. If you are ending in good terms with your current employer, why don't you try to go premium processing in your premium I-140, even if you have left your company. If you get the approval will be great, as then you can claim AC21 later on, if you get RFE that is related with the company then I think you are out of luck, unless the old company simply will want to help you.

You should be hearing from the USCIS anyway soon even without premium processing. Current dates are march 20.

Ask a lawyer about all this.

No June 06 EB2/3 approvals yet. Closest I've seen is may 30th..
 
Company A -original labor EB2 Dec 2001 (I 140 -20 Sept)
Company B -substitute labor EB3 april 02 (I 140-3 april)

I worked with company A almost 5 long year and
I have already filed I 140 with company A and in 2 to 3 day about to file I 485.

About company B I can not file I485 as priority dates is not Current .(and don't know when it will be ) at the same time company B has asked me 10,000$ for substitute labor. I'm not giving him any money,So if I'll ask for PP to company B he will ask me 11,000$ for PP.(So forget it)

I'm frustrated I waited for my original labor for almost 5 year now I'm waiting for I 140 ?????????? Can't really do pp

Now I'm planning ask my Lawyar to send 1000$ check to USCIS for premium processing for company A Lets see what will happen? Any suggestion Shall I do that?

Ask Company B to withdraw I-140 and promise to help them over weekends for any issue they can come across when you quit them

After that withdrawal you can upgrade to PP at company A

He was asking money from me , I asked him to withdraw/revoke I 140.and give it to some one else.And earn money
He told me that he is not going to withdraw/revoke I 140.It gives wrong impression toward company.Is this TRUE?

He dont know about my company A labor approval.
Now he is saying he will not give me my salary.Once I 140 will approve he want 10,000 and till then he'll hold my pay.
I said ok .
