I-140 CALIFORNIA EB2 Tracker only

CONGRATS!

i am about to renew my EAD/AP. i need some help on filing my EAD.

- what should the check by payable to "INS" or "U.S. Citizenship and Immigration Service"

- my orignal EAD was approved by Laguna Niguel. should i send the renewal to same place?

- i am on H1 and my wife is on advance parole. for q14 and 15 what should i say?

14. Manner of last entry (Visitor, student etc)

1)Answer to your fees question:

On March 1, 2003, the INS became a part of the Department of Homeland Security. Immigration fees for services and benefits previously payable to the Immigration and Naturalization Service should no longer be made out to INS. They should now be made payable to "US Citizenship and Immigration Services" (Note: Payments already submitted made payable to the "Immigration and Naturalization Service" will continue to be accepted.)

2)Yes, you must send your EAD renewal to same place (employment based).I am not sure but i am assuming as my receipt came
from there only.

3)14 for you (you must write H-1B) if you didnt use your AP to enter on your last entry to US.

14) for your wife: Write "Parolee" if she used AP to enter US on her last entry.
15)You should write for you and your wife : "Adjustment Applicant".

Fortunately, I had copy of my EAD renewal form,I am reading from it to answer to you.

ladka26 - Congrats and all the best. Could you please tell me when you went for FP? Also, you mentioned that EAD was applied on June 30th - did you file online or regular mail? What does the online message say for 485 approval?

I went for fingerprinting on April 4th,2004.
My EAD was filed using regualr paper based method.
Here is my I-485 message:

This case has been approved. On July 25, 2004, an approval notice was mailed. If 14 days have passed and you have not received this notice, you may wish to verify or update your address. To update your address, please call the National Customer Service Center at (800) 375-5283
 
Thank you for the info. One more thing, what does the online message say for the EAD now since your 485 is approved already? Thanks again and good luck.

did u query against ur case from INS. i mean did u start a query before getting approval since urs was a concurrent case.

My EAD is still pending and it says that it is currently taking 90 days to process these types of cases.
I dont think they are going to approve this case. Its message will always remain like this.
Their aim is to reduce the backlog and instead of spending time on apperoving and printing EAD,
they are approving I-485 directly providing it has been pending and I-140 and I-485 filed concurrently.
Thats my understanding and experience.

No, I didnt do any query on my case ever.Even my I-140 is pending, I never called my lawyer to do any query.
I just followed the steps of my friend in same company whose I-485 date was one month ahead of mine
and he filed EAD renewal and he got his I-485 approved in one month after filing EAD renewal.
I did the same and luckily got approved.

so is it ok to go ahead get the passport printed with GC and consider yourself permanent resident?

in other words do you still care for I-140?

Good, now everyone can apply for EAD and spend more money. Why does not USCIS ask for money directly ?

I see a lot of WAC04108**** I140/485 approvals.
FYI,my WAC04108********* EB2 CSC based concurrent I140/485 is still pending,saying that they have received fingerprints on April 17th and thats it.

So I guess March Cases do not fall under Pilot Program

Where and how did you see approvals for WAC04108**** ? Please share with us. Mine is WAC04099**** and also in same state as yours.

I am asking the same question which gcpinch asking, where did you see the WAC04108******* approvals, because mine is WAC04098******, filed concurrently I140/485 in EB2 at CSC .Even I didn't see any Jan, feb or March concurrent file case approvals.Please post here.

I think those people are kind of PILOT program..
Some of them might not be EB2/EB3...

Anyway, I support some kind of law-sue to CSC,
AC21 is no use if EB2/EB3 stop forever.

I have been scanning 13 I140 cases with RD8/8/03.
In my last scan ( done on 7/15) ...12 were received status and one with RFE response received status.
Today's scan shows..2 approved,10 received and one with RFE response received.

Looks like there is tortoise style movement. I am not sure whether the approved 140s are for non-concurrent or concurrent cases.

Hi desi145,

at least there is some move. I've been scaning ca. 50 cases in mid Sep 2003 and the last approval was more than a month ago. Overall there are 4 approvals (done in May and June 2004) and nothing since then. CSC is driving me crazy because there is no regularity whatsoever. I am hopeful everyday that I140 will get approved. My company and lawyer did not want to file concurent I485 for me so I want I140 approved ASAP to submit I485 and hopefully be able to use AC21 in 6 months or so.

A couple of months ago there was an article in Chicago Sun Times about a guy who got his citizenship at the age of 105! A friend of mine and I since then joke that with the current processing times we can end up like that guy, getting a citizenship in 70-100 years from now;-))) Hang in there. ;)
