In response to your question, U.S. is a decent country and does not recognize same marriage for a green card. I would suggest you should not waste your time applying for a visa.

Does D/S on an I-94 preclude one from accumulating illegal presence for the lottery? The I-94 was from 1989.
Applicant filed for asylum in 2001 but the case was never followed thru and was withdrawn in 2005 as they left US for Canada and was approved for asylum there.
but immigration law is a federal law, so it doesn't recognize it.Unfortunately the U.S on a Federal Level does not recognize same-sex marriage, but I think that there are 1 or 2 states that do (correct me if I'm wrong?).
