H1 Visa stamping experience- Canada

I meet and satisfy all the conditions enumerated under the law.But my billion dollar question is ...........

Does Port of Entry Officer have any descritionary powers to exercise according to his moods (positive/negative) or he is bound by the LAW to let me go, if I meet the eligibility criteria of Automatic Revalidation.

Any Thoughts???

I'm sorry, I didn't read your point 4 that your pp visa stamp is already expired. In that case one has to have an valid stamp for entry cause just 797 can't be used as visa for entry. I suggest you get some REAL expert (attoreny) advice on this...

And, one more question.

Can I schedule an appointment with American Consulate in Vancouver for visa stamping at the same time during my breif stay (3 days) as back up just in case my re-entry is refused by PoE officer at the border.

My question is..... Just by scheduling an appointment with American Consulate for visa stamping is going to attract the one of the regulations ,applying for new visa while in Canada which is a violation of "Automatic Revalidation of visa" rule.

I have read a post under visiting canada where the person was sure about the automatic reval rule and has cited references to murthy.com. please try to find that post.
you may also call POE (where you intend to cross border) about this.

Hi Guys,
I finally could get an appt. for visa stamping in Ottawa for 3rd. August. Hope it goes smooth. DSLstart i read that you ahd been to Ottawa too. Could you please tell me what kind of Q's were asked to you by USCIS officers at Canadian airport? Was it tough to answer? I am asking this coz i am on H1 and my wife on F1 so concerned.

Somehow I felt that USICS officers on Toronto airport were more tough to deal with than those on international airports in US (when you arrive at US airport POE). Lady asked me following questions :
Why are you going to US?
Why did you come to Canada?
What work do you do in US?
Tell me the main job functions?
Asked me how come you've 3 visa stamps, do you work for all
of them? (strange question)
Again somehow asked me my job tittle.
Lastly wrote my job title on back of my I-94 which was never done before..
 
Appointment date??

Guys,

I need some advice.

I am planning to take an appointment at US Consulates in Toronto/Ottawa/Montreal, but the latest date I am getting is somtimes in early Aug.
1. Is there a certain time in a day like 7:00 AM when I should check the www.nvars.com to get some open dates in July?
2. What will be the next process once I have taken a appointment date.

I need suggestions or help urgently.

I got my Ph.D from India in the year 2000. Then I started my research carear in canada as a Post Doc. Then I moved to US as Post Doctoral Research Associate in year 2002 under J-1 Visa categray.

I am currently working as a Research Specialist in University of Illinois at Chicago. Recently (two months back) my H1.B petition was approved.

I am also a Canadian Immigrant. I have scheduled appointment on 6th July 2005 in Toronto for H1-B stambing. If any one had the visa stamping experience (from J1-H1B) please mail me back. (e-mail ID gajjeram@uic.edu)

being canadian immigrant canada is your home country. I do not see probs on that account; the only suggestion, I would have for you is to take a credential evaluation of your phd degree; just to make sure it is considered equivalent to a similar degree in the US

Stamping experience - Vancouver Consulate

finished our stamping very effortlessly in the Vancouver US consulate on June 20th. The officer was very friendly and he even joked about my wife's employer being based in New Jersey.
The only other documents that the officer wanted to look at were recent paystubs.
Except for the annoying security officers at the entrance (who think they own the US of A), the stamping experience was really pleasant.

Dear everyone,

I got an appointment in Vancouver consulate for July 18th since I have to attend a conference there July 13th-20th. This conference is very important for me and i would be very reluctant to cancel the trip. However, my change of status request (F1 to H1) is still pending in California service center. Their latest update is from June 21st and they were processing cases 10 day before mine. Here are my questions:
1) Is there a high variance in processing dates for the cases with the same receipt date? For instance, if the timetable update states that on June 21st they were processing April 16th, how many days it usually takes for all April16th cases to be processed. Does it make any sense to upgrade to premium processing for me now?
2) What is a usual mailing delay between the time case is approved and the form is received? Does the premium processing have the same delay?
3) Do I have a chance of getting a visa stamp without I-797 in hands if the case is approved somehow?

And my main question (I'll most probably go to Canada if I see my petition is approved online even if the form not received hoping that my dept will receive it and overnight it to me to Canada in time for my interview. However, if mailing delays take longer - what are my options?):
4) Is it possible to come for an interview, acknowledge lack of I-797 and inquire about postponed date of the interview in the consulate without going through nvars? Nvars only has mid-august appointments for Vancouver now, they might have only September openings in mid-July...

my suggestion would be to call the nvars tel no and ask them the last question.
it may not be a good idea to travel without i-797 in hand.
 
H-1 Visa Revalidation in Vancouver,Canada

We (Me and My wife) went to Vancouver, for H-1 and H-4 Visa revalidation on May 31st. 2005. It was a piece of cake. Everythig went really smooth.
It took less than 5 minutes for the interview. The guy there was really nice,well, he didnt ask me any questions...he looked at us and said, "i know its hard to get appointment in India that quick, pick up your passpot at 3:00 PM (same Day)" That was IT!!!
As long as you have all the papers, dont worry about it.

Actually, first i spoke to XYZ Laywer , he was charging me $2800 dollars to accompany me to Ottawa and walk me through step by step. I was very inclined to go with him...you know we all are so scared of every little thing.
Than i called up Immigration.com for second openion...the attorney at Rajiv Khanna's office, kinda laughed at me, She said, :"why you want yo pay so much money ...if you have the necessary documents ..do it yourself"
Than i read more letters on this forum...felt better.
i m SOOOOOOOOOO glad , i didn'd waste so much money....infact..that $2800 dollars paid for the whole 4 days vacation plus gifts!!!

F1-H1 Stamping Clarification.....

I need a clarification regarding F1-H1 Stamping in Canada/Mexico. I am in my OPT and it expires on Oct 1st, 2005. I have been working since last November and I have an Approved H1, starting Oct 1st, 2005. Is it possible to go for stamping prior to Oct 1st, 2005?, or are there any restrictions for the same? I need to go to India immediately after Oct 1st, and i wanted to know if i could get the stamping in advance.

Congrats on getting H1B stamping.
Here is my situation:
I have the H1 stamping appt on Aug 2nd. I have 4 yrs Engg degree in Mech.
from India. I already had a H1B stamping on my passport which expired in Feb 2000. After that I came on L1 and again switched over to H1B in Sept 2003.
I am planning to go for this H1B stamping in Ottawa. I have all the paystubs and W2.

Do you think there is any risk in my degree being outside USA.
I would really appreciate your inputs.
