Hans,
Mine was filed on same date as yours. At that time the company name was Axiom but we went through a merger now and we are SPL. SPLs lawyers are dealing with my case now.
I am wondering if state labour dept sent that letter to Axiom. The address is the same, hope nothing wrong happens here.
Is anyone aware if lawyer will also be notified? Who gets the 45 day letter? Lawyer or HR of company?
 
If lawyer gets it, chances are that my old lawyer might get it. Hans can u confirm that? I will need to contact my old lawyer

I have a correction to make to my previous post.

My HR informed about the 45 day letter today.

Infact It was received by them much earlier. The date on the letter was FEB 18 2005.

I contacted my lawyer and my lawyer said that they have already responded to the notice on FEB 23.

I am really mad at my HR notifying me so late.

Anyway, I am happy about my lawyer to have repsonded earlier.

Also, The 5 digits in my case number are 05010.

could someone explain what this means and how to read this number?

The 45 day letter is sent to the Company and the Lawyer. The Lawyer needs to respond to the notice. This is what I am told.

Also, I came accross a small news item in another site about the processing in BRCs. I think most of you have already seen it or know about it. Thought it would be good to reiterate it.

Here it is. Need your comments on it.

"03/07/2005: Backlog Processing Center Processing Update

According to the AILA, the status of current processing of backlog cases at the Dallas and Philadelphia Backlog Processing Centers is as follows:
Total number of cases received from the state offices: Over 180,000.
Total number of cases completed data-entry: Approximately 86,000. Plans to complete the data-entry for all cases by the end of summer 2005. After data entry is completed on all cases, the workers would move over to processing.
Total 45-day letters issued: Over 40,000.
Timeframe for review of cases by contractors: Contractors are currently being trained. Once data entry is completed on all cases, they would move over to processing of applications.
Processing standards: They will apply the standards of each Region rather than national uniform standards. Therefore, the variance in recruitment requirement and other standards among the previous 6 Regions will be preserved.
FIFO rule: Uniform national queue regardless of the occupations.
It appears that people needs a patience.

My lawyer confirmed that the case is in Backlog reduction, here is his letter below

This is to inform you that the labor certification filed on your behalf has been transferred to the DOL Backlog Processing Center (BPC). We filed a response to the Department of Labor (DOL) Backlog Processing Center to addresses all concerns of the DOL. We expect that DOL will now place your case in line for final resolution, based upon its initial date of filing.

The BPC was intended by the DOL to centralize resolution of your case. At this early stage of Backlog Center processing, it is too early to tell whether the transfer will actually lead to faster processing, though we remain hopeful. We will monitor the situation closely.

Of course, we will notify you as soon as we have any word on your case, or learn more about the expected processing times. Once the Backlog Processing Center becomes fully operational, we expect that it will publish their processing date, and BAL will provide that information on our website as well. In that manner, you will be able to compare their processing date against your date of initial filing
 
Then what does your lawyer mean by
"We filed a response to the Department of Labor (DOL) Backlog Processing Center to addresses all concerns of the DOL"

What response is he referring to?
 
as I had my company put some pressure on the lawyer to find out what exactly is happening, the lawyer actually tried locating my file and I think, they are also helpless in this issue, and for the sake of answering, what they do is they write it in a very good way.
I think what they did is file a petition to DOL requesting any updates on my case to be let known to them.
 
45 day letter

FYI: My HR dept informed me that the 45 day letter was received on March 28 and was responded to, yesterday.

I have no communication from lawyer or HR.
 
allaboutgc and chandu, maybe you guys are already doing it but I would advice you'll to contact the lawyer and/or HR instead of waiting for them to get back to you. As it happened in my case neither the lawyer nor HR informed me about the letter. It so happened that I called the lawyer's office one day out of frustration and found out that the letter had been received by them.
 
I am in the process of changing lawyer and the old lawyer refuse to tell me anything!

I am very very frustrated these days...

The biggest problem is, my company got bought over by another and the L/C was filed by the lawyer who represented the previous company. My current company's lawyer contacted the DOL and filed a G-28 form with them requesting them to communicate with him and the current company HR.
My fears are, whether DOL will communicate this to the BPC and will BPC locate my file and add this addendum. I asked this question to my current lawyer and he says, they are supposed to but we never know. In case they contact my old lawyer and old company HR (the company still exists as a 10 member small company), I am worried they may ignore it. I already contacted the old company HR and she told me she will send me any documentation she recieves. I contacted the old lawyer, and there was no response from them. I guess both lawyers and HRs get a copy of the 45 day letter.
This is the only thing thats worrying me
 
I have some good news, my lawyer told me that my 45 day letter was recieved around March 20th. It went to the old lawyer who inturn turned it in to the new lawyer and the new lawyer handled it. They just did not bother to inform me.
