I-140 and 485 are approved

Just received two emails - one says my I-140 was approved, another says my I-485 was approved.

Spouse's I-485 has not been updated since fingerprint.

This morning, I got a call from my congressman's office that USCIS will send me and my wife FP2's immediately. They spoke with someone at VSC. This means that finally someone is looking at our files. Well, I'll believe the FP2 notice when I see it!

Anyways, in case anyone is interested, here is the (edited) letter I faxed over to my congressman's office a couple of days ago (I'm sure that you can find similar samples elsewhere on this forum, but I thought it would be useful to post something here as well).

Also, it appears that congressmen are usually more helpful in expediting matters, probably because they have a smaller local office focused on a very small region. This is just a theory, but I have yet to hear from both my state's senators...

Respected Congressman,

We are writing this letter to request your office’s help in finding the status of our Immigration Petitions for the Adjustment of Status to Permanent Resident (Form I-485 or the Green Card Application) that have been pending for more than two years.

We had filed our I-485 applications in November 2002 (Receipt Date by USCIS: 11/27/2002, Notice Date: 12/26/2002) with Vermont Service Center, Saint Albans, VT under the "First Preference" of the Employment Based Immigration Categories, i.e., the EB-1 category defined by the USCIS as:

"First Preference (EB-1 priority workers): aliens with extraordinary ability, outstanding professors and researchers, and certain multinational executives and managers."

As a part of the application process, our (XXX’s) I-140, Immigrant Petition for Alien Worker (Outstanding Researcher) was approved in July 2004, after an excruciating wait of 20 months. Meanwhile, we were fingerprinted the first time in February 2003. We have verified with the FBI, that our fingerprinting reports were quickly sent back to the USCIS shortly after our fingerprinting was complete.

The Vermont Service Center is currently processing employment-based I-485 cases received after 06/18/2003, more than six months ahead of my filing date (Please see attached document printed from the official processing dates site of the USCIS at: [url]https://egov.immigration.gov/cris/jsps/Processtimes.jsp?SeviceCenter=Vermont[/url]).

We have opened case status inquiries National Customer Service Center 2 times each for both our cases (once an inquiry is open, the next one cannot be opened for in the following 30 days). We have yet to hear from USCIS. Because there is no direct way of contacting the Vermont Service Center and because their "Case Status" website is often out-of-sync, we have been desperately watching our mail to hear about our case status. To compound matters, it has come to our notice that fingerprints and fingerprint checks by the FBI expire in 15 months; therefore, we realize that before our cases are approved, we need to be fingerprinted again and cannot do so without a notice from USCIS. We have yet to receive that notice, although it has been more than six months after the expiration of our fingerprints.

We have absolutely no clue why the adjudication on our cases is taking so long while cases filed much later than ours (6-12 months after our receipt date) are routinely being approved. We feel very desperate and helpless in this situation owing to the lack of transparency, completely at the mercy of the Vermont Service Center.

Since you are our district’s representative, we believe your interference in this matter can help expedite our case for a second fingerprinting and subsequent approval. We would highly appreciate any help that your office can provide in this matter and be much obliged and grateful for your help.

my case was just approved.
Can somebody tell me how to make appointment for pass stamping or where I should look for the information?

my husband's 485 has not been approved. should I wait until his case is approved?

Are you the promary applicant? I am asking this because I am stucked at VSC as the primary applicant, but my wife and kid got transferred to local and will be interviewd soon. I am wondering if there is the possibility that the dependent(s) could get approved separately.

I am the primary applicant.

As far as I know, genrally the family members get approved at the same time. But in my case, no. It seems to me they separately processed the cases. My husband even got fingerprinting earlier than me. Now, my case is approved, but nothing happened to his yet. It is stange, but it makes a little sense since I am the primary applicant. In your case, it is really stange. USCIS is really hard to be understood. Did you call them? Maybe the notice to you got lost?

Thanks a lot for the info

I did call them, even yesturday, and I also got a letter last month. I am sure my case is still at VSC. Well, as you said, that is how USCIS works, so I have to wait and see what will happen at the interview. I will bring my attorney, but I don't think there is any chance they can approve my case there at the same time .... except Santa helps me ... he may be too busy to do anything else than packing his bag ... wish you Merry Xmas

Congratulations Rajan and thanks for all your support in this forum. We'll be getting our passports stamed in early January as we are away over Christmas. Hopefully our plastic cards won't be too far behind.

Hey, Congrats Rajan and Waiting on your cards. Also congrats to Drniu, Izhao and Ice Tea for your recent approvals. Things are still moving forward.

I have been having LUDs last Thu, Fri and this Monday, 4 weeks after passport stamping.My wife's changed Mon. I hope it means they are actually doing something with our cards :cool:. We also had several LUDs about two weeks after PS. No online message change or email so far. We'll see ... I might give them a call late this week, or maybe next week, to see what's up. I can use Rajan's trick of asking for the welcome letter ;)

Update: one more LUD on my wife's case today (Tue 21)!

LUD changes means they are doing something about the card. My LUD changed every day from DEC 7th to DEC 16th when they had finally mailed the card.

Hi mzgh

I think there is a 1-2 week time frame typically from "card ordered" into "card received". Take a quick look at waiting's and Rajan's signatures. There is a plastic card tracker somewhere, that's another place to look at. I have no time right now though

Jut got an email, her card has also been ordered. Great !!!!!!!
 
I too recieved "card ordered" e-mail just now from USCIS. Not yet recieved for my wife's case, but it should be coming soon....
