Call your congressmen and senators. Write them letters insisting your case was treated unfairly, (list the current processing date, and your date, tell them your 1st FP was done on a certain date, and you checked with FBI that your background check was completed on xxx day, and was reported back to INS..., a lot of people who have a late receipt date already got their cases approved, and you are still waiting for your 2nd FP...) Just claim that you deserve a 2 FP notice as soon as possible.

At least that is what I did. At the same time, keep calling the national Customer service, even fax in your expedite processing request.

Just do something. I've even called in to change my address, thought I did before ;) Those little changes might be a trigger for your case.

Congrats to all new approvals. I just got back from a vacation and glad to see all the approvals ...

I am thhinking of changing job too, I guess the the long GC process makes us the same in a way :) I joked with my boss that it seems to be a total waste of freedom if I DONT change job after I got my GC ....

100% agreed - The Pandas, I forgot the details of your case, have you started a case inquiry requesting FP2 ? If not, you can (and should) do it (USCIS 1-800). If you did, and one month has passed by and nothing happened, you can do a second inquiry (I think that's the time frame they give you over the phone). Just be nice and respectfull, and at the same time let them know that you think that your case should not be lagging behind and you would like to see work on it.

As you said, and as open_sesame suggests, it's a matter of getting someone to unearth your case. You can help this happen.

Moreover, AC21 states that you do not have to stay with your employer until approval of I-845. You can change (with the restriction of staying on the same field) six months after filing. Why would this freedom be taken away from you after GC approval is beyond me. But then again, your attorney's opinion is always more relevant

EB1a and NIW are individual sponsored petitions and do not have any ties to particular jobs. The other EB based petitions are employer sponsored and there is a speculation of fraud if one changes right away, although as you say if AC21 allows one to change jobs during the petition what precludes one from doing so after approval!! The only caveat is that AC21 says same or similar job, so one cannot do anything one desires, but after one becomes a PR and remains so for some time (the duration is quite arbitrary!) one can do anything.

Excellent post waiting! (and thanks for the wishes) These are all good points. And let me add, and this is my opinion, that the chances that you will have problems with USCIS if you change fields soon after GC approval are, very, very, very small. That's my understanding at least. I would only be concerned if someone changes jobs, say, the same day she/he gets the approval, and changes field completely (say, from researcher into a pizza cook). That is, is the time frame is essentially zero, and the jobs are totally different with no doubts whatsoever.

Of course, the safer you play the more peace of mind, but if you have a very good job opportunity will you let it pass ? I'd say, ask your lawyer on what to do ... most likely you can take it.

Then again, that's my interpretation, as an addition to waiting's post, which is more factual and very informative.

open_sesame & mendieta, Thanks for your comments. I started a case status inquiry in the at the beginning of November (I think), and they responded on 11/22 saying

"Our computer systems show that your petition/application is still pending Service consideration. Please allow 90 days to hear from this office.... blah blah"

When I called again last week, they said I have to wait for 30 days after that (I guess until 12/22) to start a second inquiry.

As per open_sesame's instructions, I am in the process of doing other stuff as well (senators, etc.) Hopefully something will work! Until then, it's EAD # 3 for me & my wife!

Another interesting statistic

I took a look at time between I-485 RD and approval for posters to this thread. The results are quite interesting.

I need to double check, but I think I'm right in saying that Mendieta has the worst case of 25.5 months.

So barney (24 months), antonl (21), agroy (21), gegemon (20) stay tuned in early 2005!!

Sorry! I am couldn't write much other day. Actually I am moving to Maryland which is not far away from Delaware(!!!!!!!). Anyway, life in gautham city is mixed both exciting and vexing. If you are in scientific field and want to be productive New York is a good place but the otherthings like accomadation and
living quality it is harder here particualrly for scientists. Again it depends on what kind of person you are...

GUys, I really think we had a good feeling for the timing when we put together a little analysis a few months ago. Essentially, not only the I-485 RD matters, but also I-140 RD. For semi-concurrent petitions, the waiting time from I-485 RD is shorter, but I guess the officers look at when the whole process started. And maybe they started I140 one year before the I485. I think the prioritize those cases.

Also, very recent concurrent cases, manytimes go through in a few months, thanks to the famous USCIS memo recommending a short processing timeframe.

Oh well, hang in there folks, it's coming !

I can't believe it. Got the e-mails as well, both me and my wife (but not our 4 kids yet)
