Congrats !!! That is great, and we do hope we will have news soon about the 485. The pending review you mentioned below, what is that question? For my wife, even she got the 2nd FP done, the status still keeps as unchanged (pending review on 2/12/2003). I don't think they will update it unless they can make a decision for it.

My question is that how long is your FP now, and how many months it is valid exactly, 15 or 18 months? If it is 15 month, then it would be bad since mine has passed that line, and I may have to wait for the 2nd FP in order to proceed. How is your case then?

Hi Barney, shobhana (skusa), congrats both !

It is 15 months, I googled a bit and found several relevant hits, including this one:

Both my wife and myself are way past the 15 months mark, and her online status has always been the same (finger prints collected, pending review ..)
Not only that, my I-140 has been approved like a month ago and online status is still the same ("we received your application blha blah ... ") as if my case was still pending.

I talked to my lawyer about these things, he says not to worry about online status not being updated. He also says that USCIS does not necessarily send notification for 2nd FP right when it is 15 months since the last one. They will do it when they actually review my 485 petition for approval. He says, if I call the USCIS 1800 number now they'll tell me that I am 7 months ahead the current processing date and they will do nothing.

But I wonder if I could try go the other way around: call USCIS, trigger 2nd FP, and perhaps this way trigger the 485 ! All this discussion should probably go in the 485 forum, in fact I posted about this same issue there

LUD Change for I-140 and 485

Today I checked the status online, and mu lud was changed to 07/12/2004 for I-485. Before today, I was not able to check the status of my I-140 online and I had initiated an inquiry (three times since last year, latest 2 weeks ago). I tried to check the status of my I-140 today, and to my surprize, It is there and the LUD is 07/12/2004. Another thing I notices was that the LUD for EAD is also changed to 07/12/2004. Interestingly, I received the EAD in mail last week. I have heard that usually LUD change is a good thing. I hope it does not lead to an RFE. I have strong credentials but the sponsored company went out of business and now I am working for a big pharma. Please comment

Current Message: Your I140 IMMIGRANT PETITION FOR ALIEN WORKER was received at this office on March 22, 2003. It is taking between 90 and 485 days for us to process this kind of case. We will mail you a decision as soon as processing is complete.
 
I didnot get any email notification for the EB1-OR approval however the online case status shows its approved. what is the procedure that you guys received email? am just curious.

I did not receive any e-mails. When you register with USCIS and check the status of your applications, it shows the last updated date.

I think in the acount option you set up with USCIS has something like "email notification". I remember I set it on. So recently, everytime when some of the case got updated, I received TWO notification emails for the same thing. I am not sure why they sent two, though.
 
I do have the e-mail notification on and I did get the message when my 2nd EAD got approved. However, this time there is no change in the message and maybe that is why I did not get any e-mails. What are the chances that they are working on my case? Does anyone know that at USCIS once the officer picks up a file, do they log on to the computer as the case file is checked out and that leads to LUD change?

Help needed

Well, it is my turn to ask for help from the OR forum members. My company was gradually going under and as a it strived to survive it went through 6 rounds of layoffs. I survived the first five, but at this point all Engineers were let go, including myself. Total headcount was reduced from initial 200 down to 35 people.

I was working on H1B visa and my concurrent I140/I485 petition was filed in April 2003 and is still pending (for 15 months). I do have a second EAD card valid for ~10 more months. My employer is going to revoke my H1B visa but will not revoke my I140/I485 since I paid for the filing and for my lawyer myself.

I have a question if the cancellation of my H1B visa by my former employer will automatically cancell my I140/I485 petitions due to the fact that OR petition is employment based and I140 was not approved yet even though more than 180 days passes since filing.

Second question is, if I find another employer I think the safest route would be to apply for another H1B visa (I hope it is not subject to annual H1B quota) just in case if my pending I140/I485 gets denied so that I do not fall out of status and then just wait. Are there any chances that my pending I140/I485 is going to be approved (if not revoked due to cancellation of old H1B and application for a new H1B)? Can I start working on my current EAD card while new employer applies for new H1B?

Any inputs and suggestions will be appreciated.

So, the real issue is your immigration status. If your EB1 goes down, you only legal status is through the GC application. I understand it remains valid for a certain time, but I am not sure how long (months ? weeks ?)

In principle, if you could find a new employer now (like this week), you should be able to use AC21 (portability), because your I485 is more than 6 months old. That is, you should be able to get a new job with you EAD (assuming the new job is broadly speaking in the same field)

To the last question, yes, I think so, see above. To the "second question": yes, it doesn't hurt to apply for H1B, though it is not absolutely necessary. Academic employers are not subject to the H1 quota, you might wanna try a university as a new employer ...

I was in the exact same situation, except it was last year and the company was shut down. I was working for a startup (35 headcount) and they had to cancel my H1-B, which they did after I already received new H1 through a big parma (65000 headcount). They would bot revoke my I-140 and my attorney, who is a very well known and competent, advised me to wait and see. If no RFE comes then I am planning to file AC21 after I-140 approval. However, if RFE comes then depending on the type of RFE, I may withdraw. The attorney had further advised to apply for an NIW, which I did. I was told that if the OR falls through then I can have my NIW interfiled with the I-485 that I applied concurrently with OR application. There is no automatic cancellation of I-140, if you switch employer since I-140 is for a future job. Also, your new H1 is not subject to quota as long as your old H1 is valid. I hope that helps you. I am still waiting for my I-140.

I think I might be able to find a new job within a month (hopefully!). But while applying for a new H1B visa through new employer my old H1B could become already cancelled by old employer, depending on the relative speed of associated immigration attorneys. What would happen then? As for the H1B quota issue - I am not in academia but in a semiconductors production sector.

Thank you for mentioning possible NIW application while I am waiting on my OR petition. May be instead of NIW I can apply for another OR through my new employer and also tie it up to my pending I485?

You're very welcome!

Both your H1 status and your I140 status have a grace period after your employment with your sponsor for each ends. The best thing is to find a new job during the grace period. I don't know if it is a month or what, you'll need to find out to be in the safe side. If you do, you are fine. If you don't, things are a bit more delicate, and I'd strongly recommend a lawyer.

About starting I140 with the new employer, you can do it and I think that if it gets approved you can "attach" the existing I485 to the approved I140. But I;d keep the other I140 alive in case it gets approved sooner (you already waited a lot).

There is no specific form for the AC21. You just have send USCIS a letter stating that your new job function is similar to the last one. It is better to ask an attorney to send it.
