My GC is EB1 (outstanding prof)
My ND Dec 2002 for I-140 and I-485
I have EAD ( good for 1 year)
Here is my questions.
I have a excellent offer from diff Univ.I would like to take it without telling my univ by using EAD. in that case if my I-140 approved, Am I good?
I have H1 now. My new job they will give me H1 if I ask( to be on the safe side just in case my I-140 got rejected or RFE). But in that case to get new H1 Do I have to tell my dept? If i tell them i dont know they revoke my application or not.
Do i have any other way to that.
i called 2 lawyers. their answers are totaly different. I need a good lawyer, if anybody knows.

I would recommend not to use the EAD. Get a new H1 and then continue. Also, if you have good relationship with the current employer ask them not to revoke your I-140. If you do not have good relationship, then do not ask anything about it if you must leave. AC21 is a gray area for these situations. If there is no RFE and they do not revoke your application, then you are good. If otherwise, then you would need a very good attorney. I would recommend Sheela Murthy or Rajiv Khanna.

I agree with everything. I'd vote for Mr Khanna as attorney, or get a local lawyer that you hear good references about.
Let me just add, there is no reason not to do the new H1. It is safer (in case I140 gets revoked or something). H1s from the academia are easy. Good luck

The best of my understanding is that you are still in good shape. I also understand that you can attach your existing 485 to the NIW petition if it gets approved before the other I140
This is correct. In my case, I applied NIW with CP option. I have a excellent offer from diff Univ.I would like to take it without telling my univ by using EAD. in that case if my I-140 approved, Am I good?
I have H1 now. My new job they will give me H1 if I ask( to be on the safe side just in case my I-140 got rejected or RFE). But in that case to get new H1 Do I have to tell my dept? If i tell them i dont know they revoke my application or not.
Do i have any other way to that.
i called 2 lawyers. their answers are totaly different. I need a good lawyer, if anybody knows.

I think it is better to wait till your I-140 gets approved before changing the job. I beleive once you leave your present job and if immigration department is notified (in our university, immigration will be notified)there is a very high chances that your I-140 will be revoked. In my case I have been told by our immigration officer that if I change the job (before my I-140) I-140 will be certainly revoked.
Since your date is close (Dec-2002 )better wait unless the new offer is truly extraordinary.

The only change was the date of fingerprint receiving, It was May 20 and now the online status is showing: "On June 26, 2003, the results of your fingerprint review for your I485 Application to Register Permanent Residence or to Adjust Status were received, and processing has resumed on your case. We will mail you a notice if further action is needed, or when a decision is made."

From your past posts, I understand that time between your change of job and approval is very little. Obiviously University didn't communicate to USCIS thus the I-140 approval. They will send you RFE for 485 and asks your legal status (What visa you have or dou yoiu ahve other petition) Within 120 days you have to have any type of visa. Your EAD will be canceled if you cant show that you are still legal.Sorry about the news.I am in same situation.
