can you pl tell more about your case. my univ donot have problem for me leaving and what I understand from the rule that once the I-140 is approved and I-485 is pending for over 180days then the emplyer looses the control and cannot withdraw the I-140.and then EB1OR is based on the candidates credentials and not through the labor certification and plus here the sponsoring univ didnot pay a single penny for the petition except for the fact that the I-140 went through the official mail.

Continuing Validity of Form I-140

"Accordingly, if the employer withdraws the approved Form I-140 on or after the date that the Form I-485 has been pending 180 days, the approved Form I-140 shall remain valid under the provisions of §106(c) of AC21. It is expected that the alien will have submitted evidence to the office having jurisdiction over the pending Form I-485 that the new offer of employment is in the same or similar occupational classification as the offer of employment for which the petition was filed. Accordingly, if the underlying approved Form I-140 is withdrawn, and the alien has not submitted evidence of a new qualifying offer of employment, the adjudicating officer must issue a Notice of Intent to Deny the pending Form I-485. See 8 CFR 103.2(b)(16)(i). If the evidence of a new qualifying offer of employment submitted in response to the Notice of Intent to Deny is timely filed and it appears that the alien has a new offer of employment in the same or similar occupation, the BCIS may consider the approved Form I-140 to remain valid with respect to the new offer of employment and may continue regular processing of the Form I-485. If the applicant responds to the Notice of Intent to Deny, but has not established that the new offer of employment is in the same or similar occupation, the adjudicating officer may immediately deny the Form I-485. If the alien does not respond or fails to timely respond to the Notice of Intent to Deny, the adjudicating officer may immediately deny the Form I-485."

You are absolutely correct! University petition is only for I-140, once I-140 is approved they have no business in your future endeavors. Infact,recently I asked my University immigration officer about this she told me that if I have to leave nothing she can do or will do to stop my I-485. Practically speaking times like this where I-140 takes, unprecedented, two years or so it isn't fair to expect people to sit around and get stagnated (some time get fired)at one place to pass by the great opportunities. Fortunately USCIS seems to be
understand this(of course they are the guilty party) and are flexible in this matter. I personally know at least one example.

All of guys saying that UNiv has no right to revoke I-485 petition after I-140 approved. That is right. But Problem is If Univ tell them that you are no longer with them. USCIS will send you RFE for pending I-485.Asking your legal status.You have to have some type of visa or Other pending I-140.Outstanding proff application based on permanent job offer, eventhough they know that you wont stay forever.That is the problem.I talked that one also one of immig officer that confimed it.But I hope i am , 2 lawyer and Immig officer were wrong.

I think it is because you reply quoted, but then you don't remove the quote tags The TAGS are words that appear between square brackets: [] . They have meta-info (information for the board application, such as type of font, etc). If people try to edit your version, they simply can't, because you can't quote a quote (that is, no nested quoting).

HI! Fener!
This is the subject I am not sure of, is there a rule that University should inform USCIS once you leave the job even after I-140 approval???
I agree with you that if the University informs USCIS that you don't work with them USCIS will send you the REF for I-485.
It is expected, because I-140 is an employment based petition so USCIS want to know that you are employed or not (if you are not employed forget about I-140!). No question of visa arises here because you won't have an employment without adjustment status plus EAD or H1B.
To avoid REF one has to use AC21 (refer rpb8260 post) and inform the USCIS immediately once you leave the job. I know it isn't as simple as I say but at the same time if one follows AC21 conditions (refer rpb8260 post) it is unlikely that the case will be rejected. May be I am wrong it is just my opinion.

Just got an email stating my 140 and 485 are both approved (EB-1 OR).
ND for I-140 - 10/05/02 - EAC030055****
I-485 Feb 2003. EAC-031265****
fingerprints expiring in Aug 2003.
I guess, I am one of the beneficiary of Fujie's memo.

Was already celebrating something else, when I got the emails so I am just going to keep party-ing on...
