EB1- OR: please update your info.

NSC EB-1 OR Update

Guys

According to www.aila.org, the NSC processing date for EB-1 OR just moved forward SIX MONTHS from May 15 2003 (on Jun 1st 2004) to Nov 10 2003 on (June 15th 2004). This is still not reflected on the USCIS website.

Wouldn't it be wonderful if the same sort of thing happened at VSC? Hell, I am sure most of us would settle for May 15 2003!!!

I-140 Approvals

Guys

If anyone is interested, I have an Excel spreadsheet that lists ca. 1400 I-140 approvals at VSC in 2004 (up to June 16th), compiled from updates at www.immigrationwatch.com. Strangely there are some gaps where there appear to be no approvals:

Mar 27th to April 1st
April 23rd to May 2nd
May 18th to June 1st

Does anybody know what might have been going at VSC on during these gaps? Or have I missed some updates?

Can somebody tell what are the rejection rates of I-140 in OR category.I have not applied in any other category. I feel that my application is not very strong as I dont have publications just two abstracts.I was browsing the forum and realised that most of the people who have applied in this category have a list of publications,
What should I do

Rejection rates are low, since most of the people I have seen have strong credentials. Most important thing are the recommendation letters. As far as applying in a different category: My attorney had advised me not to have an application submitted under EB2 (except NIW) if you have one pending for EB1. The reason being that USCIS may question your EB1 qualifications.
You may either want to wait for decision or start a labour since that would take some time before you are ready to apply.

I wonder if we could do anything to speed up the EB1 OR. It is severely backlogged. Noone appears to care about it. I guess since there are not many people who come under this category. Maybe we could send a letter to some editior in one of the leading newspapers to bring their attention!!

Thank you for replying.I have strong recom letters from internationally renowned researchers,besides this I have a medical degree(not from U.S.) and Masters in Biomedical eng.I don't have a phd thou and not many publications.

I spoke to a lawyer regarding my case and he said that when I would get a reference which I guess would take 1 year then only it can be judged how bad is the reference and whether case should be withdrawn.

I wonder what does he mean by a bad reference.

I just read all these posts. Before reading the one I am quoting. I was about to say exactly the same the lawyer say. If the backlog doesn't improve much, it'll be more like two years before they revise your case. By that time, they will most likely send an RFE (request for evidence), and then you can update your academic background, and maybe you'll have other things to include. USCIS doesn't usually just refect a case, they almost always send an RFE even if it is not a stong case. So, if I were you, I'd look around what type of things would support my petition, and try to get them (papers, invited conference talks, etc)

Can you tell how many cases get rejected.

I have started working on improving my credentials.

I don't have any figures really as to "how many", but up to my knowledge things are just like 616athem just said: very low rejection rate in OR. In fact, I don't know of any rejection in this category. On the other hand, most people do have a few published papers when they apply. But my lawyer and also other people told me about PhD students getting OR Green cards with no published papers. That's all I know really

The other encouraging thing in your case is that they didn't send you an RFE in the initial quick screening when they received your concurrent petition. Apparently, USCIS would send you an RFE right away if your case looks like a very obviously "rejectable" petition. Common wisdom is that if your petition goes through the screening, and you get AP and WAD as you did, things are "going fine". This is not a guarantee of course, but it is a good sign.

I was in your shoes a couple of years back and had the same doubts. I agree with mendita's suggestions. In the interim, i suggest you look at the categoris under OR. U need to fulfill 2 out of 6. See if u can add some stuff to ur resume to fulfill as many of the 6 you can. Typically, in my experience, I have not seen too many RFEs from academic positons other than the long term feasibility of the postion. Some of the RFEs generated in this column have been from industrial positons. (i am speaking in general) However, as with KSekar etc., even the rfes after being responded to were approved soon.

then second case status referral was done on 23 of June ! I am sorry I got to go.....

Hi All

FYI, further to my previous e-mail a few days ago, this retraction has now appeared on www.aila.org:

"NSC advises that the wrong dates were provided on the 6/15/04 Processing Time Report for I-140 skilled and unskilled workers. The 7/1 report should be out shortly. In the meantime, please use the dates from the 6/1/04 report for these two categories."

I thought it was too good to be true!!

I am sorry for running away yesterday!!.
I received an e.mail stating that my I-140 has been approved on Mon, 28 Jun 2004 15:00:59 -0400 (EDT)! NO REF! Typical to all UCIS petitioner's, I could n't beleive that, finally, my day has arrived. It happened after 49 days of my first inquiry or after 4 days of second inquiry!! It is a lifting experience!
But one thing, hadn't been this forum avilable many of us would certainly have
lost our composure in this uncertain times . I am sure my approval would be an yet another example of how chaotic UCIS in choosing the time to approve the petitions.
