DV 2025 AOS (Adjustment of Status) Process Only

Hi everyone,
I came to the U.S. with the humanitarian parole program and here I got the notification that I was selected for DV program. Because I came legally and I am in status and my visa is available, i filed for AOS. However, my parole was set to expire mid 2026, but with the president's order, it will now expire next month. I guess my question is, do i have to maintain status while my AOS application is pending? or im OK bc i filed while I was in status?

One can fall out of status while their AOS is pending adjudication without the OOS situation negatively impacting the pending application.
 
Hi Everyone, My husband won the DV 2025 lottery, we got married only after he was selected. I know that the prevailing advice is to fill the DS-260 and then go forward from there. However, is there a way to do the adjustment of status without filling the DS-260?

Our CN (AS13xxx) may or may not become current based on the visa bulletin trend so we don't want to do it without being sure. So my question is, is it NECESSARY to complete the DS-260 in our case? If it's not necessary, how do we make the DV fee payment for the both of us when I wasn't on his initial DV application as his wife? Thanks in advance for any advice
Submitting the DS260 form is recommended for AOSers, especially if someone got married after the DV selection (take a look at the FAQ section of the AOS Process Spreadsheet as to why this is recommended). It however is not mandatory, one could file for AOS without the DS260 form submission, although this may lead to some additional delay during the adjudication process. We've had reported cases of selectees who got married after the DV selection, (and filed for AOS without DS260 submission), they were subsequently requested by the IO to fill out and submit the DS260 before their AOS application could be approved.
 
Mom may correct me but my understanding is that if you don’t fill in the Ds260 you won’t be added to his case. They won’t have any basis on which to do so and possibly even will reject his fee payment as being incorrect.
Both the KCC and USCIS will accept the case without the DS260 form submission, but there is the possibility of getting a RFI from the IO requiring the DS260 submission (to ensure the newly acquired spouse gets added to the KCC file) before the AOS application can be adjudicated - basically adding an unnecessary delay to the process.

While his status is now ‘New Card Is Being Produced’, mine has changed to ‘Date of Birth Was Updated’. We’ve reviewed all my documents, and the date of birth on all of them is consistent. I’m curious about the significance of this change. Should we be concerned, or do you think the status will change to ‘New Card Is Being Produced’ in the next few days?

That is an unusual update. Nevertheless, I don't think there's a reason to be concerned. So hang in there for the next couple of days, or until after your spouse's GC shows up in the mail.
 
Hi! I have a couple of questions trying to figure out if I want to apply this time or not.

About myself: I am an F1 student. Just apply for STEM OPT (c3c), awaiting approve.

1. I got selected DV2025 I'm AS 20xxx. Based on what I see, all the articles look like my number is too big. So I wonder if I should get in this time or not.
2. Relate to the first question if I decide to do it. I really can't remember whether my 2x2 photo was shot within 6 months or not. At that time, I also applied for my I765 (OPT c3b) and took that photo in April. If I used that photo to apply the DV, that's around 6 months, but it might have passed a couple of days. Do you think that's okay? I am worried that when I have an interview, this will be the reason I get rejected.
3. When I applied for the DV 2025, my status was married. But I am not living with my spouse for almost 2 years I haven't work on the divorce. So, the time I submitted the photo of my spouse isn't within 6 months (and that photo has been submitted almost 3 times; I know that's not correct). Because I haven't started my divorce case, I still need to put my spouse in my DV application. And now, I will work on the divorce case this month or next. So my question is: If I decide to do it (which means submitting the DS260), would these things cause me any problems? Or should I just give up this time and apply for DV2026?

What I am trying to understand here is that I am happy I got selected DV2025, but in my situation (the number is big, and I am not sure my photo is within 6 months and marriage status), I would like to know if I should do it or not.

I would like to know for my number and the situation still on going am I kinda too risky to apply this year? The reason I ask its I am worrying if I apply for DV2025 this year and I did not get the chance to have the interview and if I am lucky to get the H1b does it going to effect anything somehow for after if I go travel (like they will have the record I submitted DV before). I know submit DS 260 is the sign immigrant intent (recommend to do) but if I don't just pay for the DV administrative fee does that also means immigrant intent.

Summery:
1. Should I skip this year? Because the NO it's high?
2. If I don't skip this year, go through all the AOS process but did not get it. Would it be possible risky if I holding H1b visa (also if I am lucky this year) to go travel?

H1B is a dual intent visa/status, so there is no problem getting it or entering USA with it and having immigrant intent.

While H1B is indeed a dual intent visa/status which should not be impacted by an unsuccessful AOS attempt, admission or re-admission into the US is always at the discretion of CBP. Meaning, no one here can guarantee re-admission following a trip out of the US.

It shouldn’t. However for the sake of consistency, I’ll recommend unlocking the DS260 and making the necessary connections.

2) For i693, do you think that they may change the edition? There's no time limit for i-693 as they announced last year, and I got mine in February, but my number will probably be current maybe July or August. If they change the edition, then it's like a trap :/

As far as I understand it, there's nothing to 'file' in CP (unless you consider the DS-260, which of course, you can file well in advance). You just get an interview letter from the embassy when your turn comes, after you're current. Then you do your medical and go for the interview.

Usually, there's a grace period before any new form becomes mandatory, but you're right, there's a risk involved there.

As a follow-up to this question, the current I-693 online is dated 03/09/2023 which also says it “Expires 03/31/2025”. What does this expiry date really mean?

?It’s already the same. In the same way that AOS can file their AOS package early but have to wait for their CN to be current to interview, so (most) CP applicants are notified 4-8 weeks in advance of their interview but can only interview when they are current. (Obviously that assumes that the DS260 has already been submitted and processed by KCC.)

07/31/2024: 2 NL Received
08/05/2024: DV Fee Payment Receipt delivered
11/18/2024: We submitted DS-260
01/07/2025: We sent our package to USCIS (Elgin); DHL had a problem delivering for 3 days with the notification: business closed
01/10/2025: Package Delivered
01/15/2025: Acceptance Text
01/27/2025: NOA Letter Received
01/30/2025: Bio Notice Received (for 02/10/2025)
02/03/2025: Bio Rescheduled Date. Online status changed: The fingerprints relating to your Form I-485 Application to Register Permanent Residence or Adjust Status were taken.
02/07/2025: I-765 and I-131 Were Approved
02/18/2025: EAD card Received
03/11/2025: Phone Call from USCIS About the Interview (the online status didn’t change)
03/13/2025: Interview Notice Received (the online status didn’t change)
03/24/2025: Interview Date

The interview experience: The interview was scheduled for 11 am (for the spouse) and noon (for the main applicant). We arrived at USCIS around 10:40. There was a long line, but we checked in before 11:00. Our number was called around 11:30. We were taken by the Officer to the office and asked to stand and swear to tell the truth with our right hand raised. We had lawyers who prepared our application (with our help - and the knowledge we got in this forum!). We were asked to sign the document that we are attending this interview without the lawyer's presence. Then we were asked to prepare the original documents: A passport for each applicant, a Birth Certificate, a Marriage Certificate, and an Education Certificate (only the highest one). Additionally, we were asked if we had any documents to prove a bona fide marriage. We listed the documents we prepared and were asked for copies of an IRS transcript (we filed taxes jointly this year for 2024), an apartment lease (with both our names), and a joint bank account statement.

The main applicant's I-485 was opened and the Officer asked the questions from the application: full name, date of birth, place of birth; date of last entry into the US, type of category we are applying (DV), full address, current employer and role, names of father and mother, name of spouse and marital history (if any), membership in any organizations/associations, and Yes/No questions from Part 8, with the last question about Public Charge. Other items from this part were asked: the size of the household, annual household income, household assets, household liabilities, highest degree, and whether SSI or long-term institutionalization at government expense had ever been received. After a few more Yes/No questions, the application was signed by the main applicant in Part 13 of I-485.

The Notice of Interview Results was handed to the main applicant with the first option selected: “Your case is being held for review. At this time, USCIS does not require any further information or documents from you. Should further information or documents be required, you will receive a notice in the mail. We may also schedule you for another interview, you will receive a notice in the mail. Otherwise, a final decision will be mailed once your case is complete.”

Next, the spouse’s I-485 was opened, the same questions were asked, the application was signed, and the same notice was handed. The documents were returned but the passports were kept. We were asked if we had any questions. We only asked if we needed to wait for the decision. We did not ask about the outcome of the interview (maybe we should have asked…).

We were walked to the exit doors with our passports in the officer’s hand and were told that copies of the passports would be made and asked to wait outside. Our passports were returned and we were wished a nice day.

The interview lasted around 20-25 minutes. After 30-40 minutes post-interview, the main applicant's status changed to “New Card Is Being Produced”. After 1 hour, the spouse's status changed to “Date of Birth Was Updated”. In the evening, we chatted with an agent using EMMA to check what it meant. The agent said, “Your card was approved and is still in production and has not been mailed”. 24 hours later, the status is still “Date of Birth Was Updated”.

We will update the spreadsheet when the Green Card is delivered.

I think it was important for people who filed i693 before April 2024. The statement says "Effective April 4, 2024, any Form I-693 that was properly completed and signed by a civil surgeon on or after Nov. 1, 2023, does not expire. You can use it indefinitely as evidence that you are not inadmissible on health-related grounds."

So I guess even after March 31, we can use the forms prepared before that date because it should not expire. I guess @Sm1smom may have a better explanation. I am just guessing.

As far any any USCIS form is concerned, the applicable "Edition Date" is what an applicant needs to be mindful of, the "Expiration date" is of no concern to applicants.

So even if I send my documents in August, my form will not be rejected because of this "expiration date: 03/31/2025" in my form, right?

Also after 03/31/2025, if they put another form with further expiration date, do you think that they may change the edition of i693 form?
