DV 2024 AOS (Adjustment of Status) Process Only

Is there any section of the I-485 asking for a permanent address?
Perhaps my expression was not very clear. My question is, for my wife, should she fill out Sections 5 and 7 with my current address and her current address respectively? All the date at "to" part (6b and 8b) should be present?

No the civil surgeon told me that there is no need to include hep A. As in he won’t mark hep a, only hep B is needed. Is that true?
The CS cannot leave any section of the vaccine worksheet blank. One of the sections in the Red Square on the screenshot in my previous response must be marked as applicable for each listed vaccine.

Right. You were asking about "permanent residence" in your previous post, and I wanted to make it clear there's no question about "permanent residence".

Your wife will list both your address and hers in under questions 5/6, and 7/8 respectively. Yes, the "TO" part for both should be listed as 'Present"
 
Hello! Quick question on travel whilst your application is processing.
My DV number will come current in Jan and I plan to file my application early in the month.
However, my honeymoon is actually at the end of the month (international travel). We are both on H1B visas so my understanding is that it is acceptable to travel and reenter the country, however I wanted to just double confirm that there are no risks to this (other than the standard risk of reentry always being subject to the discretion of immigration officers).

Other potential risks - receiving a RFE while out of the country, being scheduled for an interview, or being asked to come re-do the bio while out of the country.

Hello! Thank you so much for a great resourse I found in this forum. My mother is winner of 2024! EU (Ukraine) and her case will be current in January 2024. We filed DS 260 back in June when she was residing in Ukraine. As of August 2024 she was granted a humanitarian parole under Uniting with Ukraine program. KCC recently scheduled her appointment in Frankfurt , Germany for the end of January. We wrote an email to KCC to notify them of our desire to switch to AOS processing to save my mom a travel abroad. Also under humanitarian parole she is not able to travel back and applying for advance parole while having a parole - it's almost impossible. We've got a reply from KCC saying that all inquiries should be transferred to the Consulate since her interview is already scheduled. They simply canceled her appointment due to our request. Now KCC wrote us this email:


Thank you for your inquiry.
KCC has reviewed your request to change your interview location. Based on the circumstances of your case, KCC denies your request to be reassigned. The place of application, i.e., location of interview, for noncitizens seeking an immigrant visa will normally be in the consular district with jurisdiction over their place of residence, with limited exceptions.

What else we can do? Keep writing them or try to make a call.
Also is there any chance simply apply for adjustment of status? or we supposed to get a positive response from them first.

Hello, Have you seen folks successfully re-entering the US while their DS-260 is submitted (fees paid) but I-485 is not submitted yet? I am on TN and am wondering if i can renew my TN visa (as it expires on mid 2024) without any issue. I looking if i can renew my TN and continue working until my case gets adjudicated.
Appreciate your feedback.

When did you first inform KCC of your plan to switch from CP to AOS?

1. Yes I’ve seen folks who already submitted the DS260 successfully re-admitted into the US back into their existing status (they already had valid visas which they used in seeking re-admission).
2. Rather dicey with a TN considering you’ll be seeking a new TN in this case. A demonstrated immigrant intent will most likely preclude an approval of a new TN.

When contacting your local USCIS office they may inform you that you will not be eligible to file your adjustment until your case number is current and available for processing. Please refer to the visa bulletin at to view the current case numbers being processed. This bulletin is updated after the 15th day of each month.

Are we good to submit AOS application in the beginning of next month? Or should we ask for 2NL?

You guys left it rather late in informing KCC of the switch from CP to AOS. This should have been done before the case gets scheduled for a CP interview because once that happens, the case gets transferred to the applicable embassy and KCC no longer has anything to do with it at that point.

Since you said KCC has gone ahead and canceled the scheduled interview, your only option at this point is to proceed with AOS and hope KCC will be willing to retrieve the case file from the embassy and forward it to the applicable FO when the assigned IO requests for it in other to approve the AOS application.

Forget about asking KCC for the 2NL, it is irrelevant at this point. Have you already made the DV administrative fee payment?

Thank you for your response. We made a payment to process with AOS few days ago. The money order hasn't been cashed yet.

Hi mom, I checked my wife's copy of i693, and I find that the CS didnt complete the sections for Heb B and varicella with an "X". SHould I have this corrected?403410905_323586377279284_4530731346316507575_n.jpg

I have got 4 of parking tickets last year all within 70usd. Do I have to report this in the I 485 ?
This is debatable, some would say parking tickets do not need to be listed on the I-485. However, considering one of the questions on the form is have you ever been "cited", ... etc., I would rather err on the other side of caution by listing them for my peace of mind.

I got my EAD in a month this Yr.
I read in the faqs that she will have to exit usa If the Aos application fails.
Can’t she return in h4 or f2 later if se has to leave, subject to Aos failing.

1. I can’t predict how long the EAD approval might take.
2. Yes she can return IF CBP is willing to overlook the previously declared immigrant intent, and she has the right visa for seeking the re-admission.
