DV 2024 AOS (Adjustment of Status) Process Only

Sorry I'm not sure if this was asked yet, but I figure you repeatedly answer the same questions all the time, and btw I love your blog, so full of rich content and super helpful to us who aren't using a lawyer and doing the process ourselves. That being said I have 2 questions:

1) My brother in law is in the process of AOS for the DV lottery and his daughter has her passport expiring in January 2024, we are highly doubtful they will get a response about the outcome of the AOS by then, is it detrimental to case if the passport expires during the AOS pending?

2) My brother in law and his family are here on Humanitarian Parole, so this status renews every year until the CBP decides not to automatically extend it. What happens if my April 2024 (when their parole expires) they don't have a decision on the case, are they allowed to stay in the US when the AOS is pending, if the parole isn't extended?

And just for reference they had the biometric appt waived already since they already had fingerprints from prior work authorizations, just waiting on the next notice, like interview date or if more evidence is required.

1. Passport expiration is not detrimental to the case. However, does she have some other form of a valid government issued ID? If they’re invited for an interview, she’ll need to present a valid government issued ID in order to be allowed access into the FO. So if she currently has no other form of ID, I recommend getting her a State issued ID right away.

2. Yes they’ve eligible to continue staying in the US while their AOS is pending if current status expires during that period.

p.s. if you could add your brother-in-law’s case details to the Timeline spreadsheet, that would be greatly beneficial to other folks equally going through the process. Plus it would be your way of paying it forward - that’s part of what makes this forum stronger, helpful, and better.

In that case she does not. As long as the parent has a valid government issued ID.
 
Hi! Thank you so much for this forum and all the resources! I am currently on OPT that is valid for another 8 months and I am doing the AOS process, my number's EU8XXX. Two days ago I was laid off from my job. I am very devastated and shocked that this happened and very worried about my AOS process. I don't have anyone to ask to financially support me, so I am thinking to file for the unemployment while I am looking for a job. 1) Will unemployment affect my AOS process? 2) Has anyone been in the same situation and what can you suggest? Thank you!

Filing for unemployment, (if eligible), on its own should not affect the AOS process. However if you’re still not employed as at when you file or get scheduled for an interview, then that will most likely be an issue.

Can you please expand on why it would it be a problem if I am not employed during the time of interview? Most probably my work visa will expire after AOS filing and by the time my interview takes place.

Try not to compare apples and oranges please. You need to read and interpret my response within the context of the question it was provided for, it is not a “general” response.

The response is in relation to an applicant with work eligibility who however is not employed and is surviving on unemployment benefits. They also may be deemed ineligible to file for AOS if filing within the 60 days grace period and is still unemployed at the time of the interview. Certainly not the same situation as someone whose current status expires, and is subsequently not able to work due to not having a valid work authorization, while their AOS application is pending.
 
Just a quick question everyone. My current case is in December. Dropbox delivery date was 10.16 looking at the tracking information. I have not received yet any txt or email from USCIS with from G-1145 filled out. I understand that I am in the "hurry up and wait" phase but wanted to ask if there is anything I can prepare for, that can be done if let's say by 11.15 I don't get a notification.
Looking at the 2023 AOS Spreadsheet I see that some people got notifications of acceptance from 5 day to 30+ days from the lockbox delivery date. So I am just more or less anxious and not worried about the longer delay at this point but still...

1. Which Lockbox?
2. Have you checked to confirm if your payment has been cashed?
3. Are you listed on the 2024 Timeline spreadsheet?

Ok. Give it till the end of this week and if there’s still no update by then, the potential for a rejected package cannot be ruled out at that point. In the interim, I suggest you take a very close look at the copy of the I-485 from you sent in to confirm the form was accurately filled out and signed as required.

Also consider making your user name one the Timeline spreadsheet match your forum username so we don’t keep asking if you’re listed on the the Timeline spreadsheet.

Got it. I will wait then. Can I get a confirmation from them about the rejection some how? Will the package be sent back? I would like to make sure I don't send 2 different packages.

1. No there’s no way to get any confirmation in that case.

2. From your experience how long will it take to receive the package if the application has been rejected? I can't see a timeline anywhere. and Google search does not help either

Could be anywhere within a couple of days to a couple of weeks.

I've read the spreadsheet and it says that I need to wait for my case number to be current to submit the documents, there is just a lot of information and I was confused if I can send my I-485 before and they will just schedule an interview after the case number becomes active
