DV 2023 AOS (Adjustment of Status) Only

If my CN becomes current for February does it mean I have to send my package within that month or is that like the earliest possible month of my package getting accepted? Thank you for your time.
Neither. If you are current in Feb, you are eligible to send your packages on February. However, if you would like to benefit from early filing, you can submit your package a few weeks prior to that (See AOS spreadsheet). You may send your package later, But consider that you only have by September to get your GC approved. So sending later may deteriorate your chances.
 
hi mom, I am lost and I am here again to ask for an advise. Like I said in previous So I enter the U.S. in 2021 December on b2 had given leave date June 6, 2022 . In may of 2022 I found out I won , didn’t read any rules of dv out of excitement, and thought I could start the process and paid my DoS fee and received receipt . Then I left because my daughter in law said you can’t start the process till october 1, 2022. Then I left on June 6, 2022. When I was home country my daughter in law told me that my case number was high 23k for EU so probably interview won’t happen till may-July of 2023. . So we decided to visit USA with my husband because he never saw our son since 2019 and sons kids . I and my husband came back to USA on September 5, 2022 due to having a new born few month grand baby here , and planned to leave on 1/28/2023 had tickets to fly back . My son and daughter in law said we could adjust status here in case if numbers become current so we paid my husband Dos fee at end September. And as a surprise when we check visa billeting in January we saw our numbers are current and decided to do adjust here . So I started reading a lot and found this forum read all previous posts and your answers that’s when I decided not to do here out of worry to get denied. I didn’t intent when I came here , but as you said in other post not sure if I can prove that at interview. What do you Suggest, do you think we have a chance here to get all approved . If so I wanna ask my family in Azerbaijan to mail our high school diplomas and my husband military record and marriage certificates. Thank in advance for advices .

I already answered you as best as I can. I'm surprised you're still asking what I think considering you acknowledged my last two responses. If after reading those responses (added below to refresh your memory), and you're still not sure of what to do, I don't think I can be of further assistance to you:
I see. Now that I have a better insight into your situation, I think you should be fine to proceed with AOS in this case. I wouldn’t switch to CP if this was my case based on the above explanation.
But how I will prove them that I didn’t intent , I have been coming to USA past 3 years every year 6 month . I am just worried since I paid Aos dv fee back in may 2022 and for my husband in November of 2022. They will think we did purposely. But we really didn’t . We were planing do consular due to financial but since son said he will cover cost that’s why I decided to stay here . Maybe I should risk it like you say .

Ok got it . One more question so I am sending I-485 . But problem I have been trying to request my receipt DOS copies from KCC but no luck . I paid both . Mine came but husband didn’t since September 2022. Will I be able send without his receipt and once it’s comes and I take to interview

It will eventually come. Keep following up with KCC about every other week. Yes, you can send the package without his payment receipt.

I recommend you spend some quality time going over the AOS Process Spreadsheet first before you do anything else - there are several tabs/sections on that spreadsheet - so be sure to go over all of them.

I will be sending my DV fee payment in form of postal money orderto this same address. Is that fine?
 
You do not need authorization from USCIS or KCC before completing the medical report. You decide on your own as to when you should. What matters is for the medical report to be completed by one of the USCIS approved CS.

"We are extending our temporary waiver of the requirement that a civil surgeon sign your Form I-693, Report of Medical Examination and Vaccination Record, no more than 60 days before you file Form I-485, Application to Register Permanent Residence or Adjust Status. This temporary waiver has been in effect since Dec. 9, 2021, and will remain in effect until March 31, 2023."
From what I can make out of the above , if one's Civil Surgeon signs your I-693 form say on March 30, 2023 you are no longer bound by the 60-day period to submit your I-485 for the medical exam to remain valid for the AOS application. Is that a correct reading of the USCIS Alert quoted above? Please advise. Thanks
 
Hi, Do I need to include Toll violation and any parking violation, do it comes under traffic violations?
This is debatable, some would say NO. Considering one of the questions on the form is have you ever been "cited", ... etc., I would rather stay on the other side of the debate for my peace of mind.

That is correct. It is documented on the AOS Process Spreadsheet - the reason I keep hammering on folks to spend some quality time on the spreadsheet.

Thank you for the reply. So there is the details. I am a DV 2023 selectee with a number EU30xxx . So far the visa bulletin is at 26 000 for Europe and my case will be current in April or May the latest. I can file the I-485 as soon as it is current. My biggest fear and question is, in how much trouble am I? I am an F-1 student currently in OPT, but I have engaged in unauthorized work during my studies and it is more than 180 days so no exemption applies. In no way i am going to lie and say I have not, so basically admitting that I violated the terms or my F1 status. Do I have any slight chance of getting a green card, or the worst, will i get my F1 terminated and get deported out of the US ?
Please help and also thank you!

Status violation makes you ineligible to process AOS. Filing an AOS application with a status violation (and without a waiver) is like poking the sleeping giant. You however have a chance if you go the CP route as the DS260 does not ask about previous or current status violation.

This is much appreciated! What is the CP route and is that requiring us to go to our home countries? I really am not aware of the CP process.

It is not an option to go back to my home country for CP, so would you suggest just leave it and not file so at least I can maintain my F1 and remain in school ?

CP - Consular Processing. Your submit the DS260 form, collect the applicable documents and wait for the KCC to schedule your interview with the applicable embassy with jurisdiction over your local home address. So yes, you’ll need to leave the US to attend the interview.

I suggest you go over your selectee letter again (carefully), it has all the information you need to proceed.
