DV 2023 AOS (Adjustment of Status) Only

Thank you again, just last question. Is sponsor's w2 along with Affidavit of Support required by uscis? I cannot find any information from uscis or kcc about including w2 of the sponsor in the AOS package, but I have heard that I need to include sponsor's w2 from last three years. Thank you so much for all the help!

Including a sponsor’s financial information is recommended if an applicant is unable to demonstrate they the personal mean of overcoming being deemed a public charge. Please go through the FAQ tab of the AOS Process Spreadsheet for more explanation regarding the recommendation to include financial documents with the AOS package.

Hi,
My current passport is getting expired on December 2023. I have applied for a new passport, but it is still being processed, I might get it earliest by February end and latest by end of march or April. My CN might become current in March. So as part of the AOS package is it alright if I just send my old passport copy? or is my new passport front page copy also required? Thank you for your time.

Not required.

Hello,
Maybe somebody can help me - I came to the US with Uniting for Ukraine program (U4U, UHP) and won DV2023, can I do an Adjustment to Status?
I heard different versions - Yes, I can, because it is a DV lottery. And No, because it is a humanitarian parole, and it is not a status. Will be very appreciative, if anybody has any additional information.

Hi Sm1smom,

I live in Louisiana and for Louisiana is this the correct address for lockbox for Diversity Visa ? I'm applying with my spouse.

I believe yes you can AOS because you were inspected and paroled into the US. According to USCIS Manual, one of the requirements of AOS eligibility is to be "inspected and admitted"; or "inspected and paroled".

This 2011 USCIS Presentation deck on Humanitarian Parole Program also supports the assertion by the way.

Plus if you take a look at the 2022 AOS Timeline Spreadsheet by the way, you will see a reported case of a successful AOS from U4U humanitarian parole.

That is correct.

Hi Sm1smom,

I will be mailing my AOS package in the beginning of next week. My CN became current in January, also I decided not to file DS260. Residential/ mailing address that I put on my applications is in another state, where I got to school. I will return to that state in early May from my internship. Am I likely to be scheduled for bio or even an interview before that date? Most importantly, would that have to be in the state where my residential/ mailing address is? If that's the case can I change the location? Thanks!

Both the bio and interview location (ASC and FO) are assigned based on the residential address listed on the I-485. However in situations where the residential address is in a different location from the mailing address, it wouldn’t be unusual for USCIS to use the mailing address location in scheduling the bio and the interview. And no, you cannot simply change the interview location. And yes, the possibility of being scheduled for your interview before May cannot be ruled out.

S1mom.
1.Is the receipt from KCC after paying the $ 330 a requirement for the submission of the AOS package ? and typically how long does it take for one to get the receipt back from KCC
2. Could you explain what the biometric is about and at what stage it is needed

3, In case of missing documents eg orig passport of entry, 1-94 form (entry date too early to be retrieved online) and absence of other documents to establish physical presence using 245i , what would you recommend an applicant do.
USCIS website mentions a Personal Affidavit , do you know how that is done?
Thanks for help

1a. Take a look at the AOS-FAQs tab of the AOS Process Spreadsheet.
1b. Take a look at the Timeline spreadsheets (both DV2023 and past couple of years) to get an idea of how long on average it takes to get the KCC payment receipt, which by the way is also covered on the AOS Process Spreadsheet itself.
2. Take a look at the “Background Check” tab of the AOS Process Spreadsheet for an explanation of what the biometric is, and the “AOS Process” tab of the AOS Process Spreadsheet to see at what stage it is needed.
3. Other than the already listed documents on the AOS Process Spreadsheet for demonstrating proof of maintaining a valid status and/or valid entry/admission admission into the US, I recommend you speak with an experienced immigration attorney.

Hi,
My CN is 2023AS89XX for region of Iran, cut-off number for Iran in February is 5500. I am main applicant and have 3 dependents, my two kids and my spouse.
1. Kindly please let me know is it good time to pay KCC fee now?
2. should I make money order 330$ for each member or total 1320$ for all?
3. In case of USCIS fee for filing i-485, how would be payment for my kids as they don't have any bank account? Can I pay with bank check with my name?

Thanks a lot for your kind answer.
